第一章 总则
第一条 为了规范和引导公民文明行为,培育和践行社会主义核心价值观,提升城市文明水平和公民文明素质,根据有关法律、法规的规定,结合本市实际,制定本条例。 第二条 本市行政区域内的文明行为促进工作,适用本条例。本条例未作规定的,适用其他相关法律、法规的规定。 第三条 本条例所称文明行为,是指遵守宪法和法律规定,符合社会主义道德要求,体现社会主义核心价值观,维护公序良俗、引领社会风尚、推动社会文明进步的行为。 第四条 文明行为促进工作应当构建政府组织实施、各方分工负责、全社会共同参与的工作机制,保障本市文明行为促进工作持续、有效开展。 第五条 市、区(县级市)精神文明建设委员会统筹推进本行政区域内的文明行为促进工作,其所属的精神文明建设工作机构负责文明行为促进工作的组织实施,履行下列职责: (一)拟订文明行为促进工作规划和计划; (二)指导开展各类志愿服务活动; (三)指导各行业主管部门、行业协会制定行业行为规范,并监督落实; (四)指导、协调相关部门开展文明行为促进工作; (五)督促、检查文明行为促进工作落实情况; (六)定期评估和通报本条例的实施情况; (七)督导相关部门受理并按照规定办理有关举报、投诉; (八)其他文明行为促进工作。 市、区(县级市)应当建立文明行为促进工作联席会议制度,协调解决有关重大问题。 第六条 市、区(县级市)人民政府应当将文明行为促进工作纳入国民经济和社会发展规划及年度计划,制定相关政策措施,将文明行为促进工作经费纳入财政预算予以保障,并做到专款专用。 市、区(县级市)人民政府有关部门应当按照各自职责,做好文明行为促进工作。 镇人民政府、街道办事处应当按照有关要求,做好本辖区内的文明行为促进工作。 村民委员会、居民委员会应当加强文明行为宣传和引导,协助相关单位开展文明行为促进工作。 第七条 国家机关、企业事业单位、社会团体、其他组织和公民应当参与文明行为促进工作。 公职人员、公众人物应当在文明行为促进工作中发挥表率 作用。 第八条 市、区(县级市)人民政府有关部门应当建立不文明行为举报、投诉、查处制度,公布举报投诉电话、邮箱等,受理举报、投诉,并对违法的不文明行为予以查处。 任何单位和个人发现不文明行为,有权举报、投诉。
第二章 基本行为规范
第九条 公民应当爱国守法、明礼诚信、勤俭节约、敬业奉献、团结友善、敬老爱幼,遵守市民文明公约、村规民约、社区居民文明公约、行业守则等文明行为规范。 第十条 公民应当维护国家利益和尊严,爱护国旗、国徽,尊重国歌。 第十一条 公民应当爱护公共环境,自觉遵守下列规定: (一)不随地吐痰、便溺,不乱扔垃圾、乱倒污水; (二)不在禁止的时间和区域燃放烟花爆竹,不在室内公共场所和其他禁止吸烟的场所吸烟; (三)不在露天焚烧秸秆、垃圾和其他废弃物,不在禁止的区域露天烧烤; (四)不在公园、道路及其两侧等公共场所和居民小区抛撒冥纸,焚烧冥纸、逝者遗物和其他丧葬祭奠物品; (五)不在建筑物、构筑物的外墙、楼道、电梯和树木、户外管线以及其他户外设施上非法张贴、涂写、刻画和挂置宣传物品; (六)不在临街建筑物的阳台、窗外等空间堆放、吊挂有碍市容的物品,禁止从建筑物、构筑物向外抛掷物品; (七)不在批准的时间和场地以外摆摊设点,不擅自占用道路; (八)集贸市场、便民网点和流动摊位商户保持摊位周边清洁; (九)文明如厕,不在公共厕所墙壁和其他设施上涂写、刻画不文明语言、图案; (十)其他公共环境卫生管理规定和文明行为规范。 违反本条第一款第一项规定的,公共场所管理人员、文明行为协管员(监督员)应当进行劝阻;经劝阻后仍不改正的,应当告知城市管理执法部门予以处理。城市管理执法部门应当对违法行为人进行批评教育,责令其清除污染物;拒不改正的,处二百元以下罚款。 违反本条第一款第四项规定,在公园、道路及其两侧等公共场所抛撒冥纸,焚烧冥纸、逝者遗物和其他丧葬祭奠物品的,公共场所管理人员、文明行为协管员(监督员)应当进行劝阻;经劝阻后仍不改正的,应当告知城市管理执法部门予以处理。城市管理执法部门应当对违法行为人进行批评教育,责令停止违法行为,收回抛撒物,并将污染场地清理干净;拒不改正的,对抛撒冥纸的,处五十元以上二百元以下罚款,对焚烧冥纸、逝者遗物和其他丧葬祭奠物品的,处一千元以上二千元以下罚款。 违反本条第一款第六项规定,从建筑物、构筑物向外抛掷物品的,公共场所管理人员、物业管理人员、文明行为协管员(监督员)应当进行劝阻;经劝阻后仍不改正的,应当告知城市管理执法部门予以处理。城市管理执法部门应当对违法行为人进行批评教育,责令停止违法行为,处五十元以上二百元以下罚款;情节严重的,处二百元以上二千元以下罚款。 第十二条 公民应当遵守公共秩序,自觉遵守下列规定: (一)在公共场所着装整洁,举止文明,不大声喧哗,不说脏话; (二)购买商品和等候服务按序排队,使用电梯先下后上,使用自动扶梯依次有序,礼让老年人、妇女、儿童和残疾人,乘坐电梯时不跳跃、打闹或者击打电梯; (三)商业促销和组织娱乐、健身等活动合理选择时间和场地,使用音响设备的,应当控制音量,不干扰他人正常生产生活; (四)从事甩钢鞭、投掷飞镖等健身活动应当选择安全的场地,不危及他人安全; (五)不在机场、铁路、电力线路等周边和居民小区等人员密集区域升放风筝、放飞无人机; (六)规范养犬行为,饲养犬只不干扰他人正常生活,携带犬只出户采取必要的安全防护和卫生清理措施; (七)爱护公共设施设备,不损坏花草树木; (八)其他公共秩序管理规定和文明行为规范。 违反本条第一款第二项规定,乘坐电梯时跳跃、打闹或者击打电梯的,电梯所有人、使用人或者电梯安全管理人员应当进行劝阻;经劝阻后仍不改正的,应当告知公安机关予以处理。公安机关应当对违法行为人进行批评教育,责令改正;拒不改正的,处二百元以上五百元以下罚款。 违反本条第一款第四项规定的,公共场所管理人员、物业管理人员、文明行为协管员(监督员)应当进行劝阻;经劝阻后仍不改正的,应当告知公安机关予以处理。公安机关应当对违法行为人进行批评教育,责令改正;拒不改正的,处二百元以上五百元以下罚款。 第十三条 保护生态环境,践行绿色、低碳的生活方式,减少使用塑料购物袋、一次性生活用品,适度合理包装。 节约资源,鼓励使用节能、节水、废物再生利用产品,分类投放、收集生活垃圾。文明健康用餐,反对浪费。 第十四条 机动车和非机动车驾驶人应当遵守道路交通安全法律、法规,文明驾驶。机动车驾驶人应当自觉并教育乘车人不向车外乱扔垃圾;经过人行横道时提前减速,礼让行人,依法使用灯光、喇叭,不以手持方式使用电话,不抢道行驶,不占用应急车道,不遮挡消火栓,有序停放车辆。驾驶非机动车应当在非机动车道内行驶或者靠车行道的右侧行驶,不得逆向行驶或者并排行驶。 乘车人乘坐公共交通工具应当遵守乘坐规定,有序上下,主动为老、幼、病、残、孕和怀抱婴儿的乘客让座,不得携带易燃易爆和有异味物品。提倡老年人避开上下班高峰期乘坐公共交通工具出行。 行人应当按照规定通过路口或者横过道路,从人行横道快速通过,不得跨越道路隔离设施。 共享车辆使用人应当遵守服务协议约定,不得破坏、损毁、侵占或者擅自改装共享车辆,不得乱停乱放。 第十五条 公民应当文明旅游,自觉遵守下列规定: (一)爱护文物古迹,尊重当地风俗习惯和宗教信仰; (二)不参与有辱国家尊严和民族感情的活动,不违反规定拍照、录像; (三)服从景区引导、管理,不从事危及他人和自身人身财产安全的活动; (四)不在景区建筑物、构筑物、公共设施、树木上攀爬、刻划、涂污; (五)其他文明旅游管理规定和文明行为规范。 第十六条 公民应当文明上网,不编造、散布虚假信息,不以发帖、跟帖评论等方式侮辱或者诽谤他人,不播发、转发道路交通事故、火灾等灾害现场血腥画面或者伤害公民情感的照片、视频,不得允许未成年人进入互联网上网服务营业场所。 第十七条 爱岗敬业,遵守职业道德、工作制度和操作规范,尊重服务对象,提高服务质量。 窗口单位工作人员应当使用文明用语和规范用语,热情周到服务。 公民应当自觉履行法定和约定义务,诚实守信。商业经营者应当合法诚信经营,明码标价,不欺骗、误导消费者,不做虚假广告,不以次充好,不出售不合格商品,不强买强卖。 第十八条 公民应当遵守社区文明行为规范,自觉遵守下列规定: (一)邻里之间和睦相处、团结互助,爱护和合理使用公共空间、设施设备,参与楼院、社区的公益活动; (二)不违法搭建建筑物、构筑物,不乱停乱放车辆或者堵塞消防通道; (三)装修房屋不干扰他人正常生活,不野蛮装修影响建筑安全; (四)不侵占公共绿地、草坪等种植蔬菜、水果等农作物,不占用公共空间堆放物品和饲养家禽、家畜等动物; (五)其他社区物业管理规定和文明行为规范。 第十九条 家庭成员之间应当敬老爱幼、相互扶持、相互尊重、平等相待,培育和弘扬良好家风。 赡养人应当履行对老年人经济上供养、生活上照料和精神上慰藉的义务;与老年人分开居住的赡养人,应当经常看望或者以电话、网络等方式问候老年人;赡养人应当尊重老年人的婚姻自由,不得干涉老年人离婚、再婚及其婚后的生活。 父母等监护人应当履行对未成年人的监护职责和抚养义务。对家庭成员中的残疾人应当履行扶养义务,并鼓励和帮助残疾人增强自强自立能力。 第二十条 公民应当尊师重教,协助教师做好学生的教育培养,不得以任何方式干扰教育教学秩序。 第二十一条 公民应当文明就医,尊重医学规律和医务人员,不得侮辱、诽谤、威胁、殴打医务人员,不得在医疗场所聚众闹事。 第二十二条 公民应当在指定区域选择安全地带从事垂钓、游玩等亲近海洋活动,不得破坏海洋资源和生态环境。 第二十三条 关爱、尊重英雄、烈士、军人及其家属,不得以任何形式侮辱英雄、烈士和军人。 第二十四条 移风易俗,文明办理婚丧事宜,文明祭扫。 第二十五条 热情真诚对待外来人员,并提供力所能及的帮助。
第三章 鼓励与促进
第二十六条 市、区(县级市)人民政府和有关部门应当建立健全文明行为表彰奖励制度,制定关爱道德模范、身边好人、文明市民等文明行为先进人物的政策,帮助其解决实际困难。 第二十七条 市、区(县级市)精神文明建设工作机构和有关部门应当宣传文明行为规范、文明行为礼仪和文明行为典型事例,营造鼓励和促进文明行为的良好氛围。 报纸、广播、电视、网络等公共媒体应当传播文明行为典型事例,刊播公益广告,曝光不文明行为。鼓励自媒体刊发、传播积极向上的文明用语、视频等宣传品。 鼓励、支持、引导单位和个人以提供资金、技术、劳动力、智力成果等方式参与文明行为宣传。 第二十八条 市、区(县级市)人民政府有关部门或者社会组织应当建立文明行为记录档案,按照自愿原则,对公民参加慈善公益、志愿服务、见义勇为和文明行为宣传教育等活动予以记录,作为实施表彰、奖励的依据,并将其纳入公共信用信息管理系统。 第二十九条 鼓励单位和个人开展赈灾捐赠、扶贫、助残、救孤、济困以及助老、助学、助医等慈善公益活动,为社会弱势群体提供帮助。 第三十条 鼓励实施与自身能力相符的见义勇为行为。单位和个人应当支持见义勇为行为,尊重和保护见义勇为者。必要时,对见义勇为者及其近亲属给予救助。 第三十一条 鼓励无偿献血和自愿捐献造血干细胞、遗体及器官;医疗机构及医务人员应当对捐献者遗体进行符合伦理原则的医学处理,维护捐献者的尊严。 无偿献血者个人及其配偶和直系亲属在使用血液时,依法获得优先、优惠待遇。 第三十二条 鼓励和支持建立各类志愿服务组织,拓宽志愿服务领域,开展多样性志愿服务活动。志愿者参加志愿服务活动的,所在单位应当给予支持。 建立完善志愿服务嘉许回馈等制度,保障志愿者的合法权益。志愿者有困难时可以申请优先获得志愿服务。 第三十三条 鼓励、支持和保护公民为需要紧急救助的人员实施紧急救助或者提供必要帮助。 第三十四条 鼓励全社会关爱空巢老人、留守儿童、失独家庭、残疾人和外来务工人员未成年子女。有关部门应当加强对家庭监护和委托监护的督促指导。 市、区(县级市)人民政府和有关部门应当采取措施,为外来务工人员提供劳动就业、子女入学、法律援助等服务,提高外来务工人员的同城待遇,增强其认同感和归属感。 第三十五条 鼓励和支持全民阅读。市、区(县级市)人民政府和有关部门应当加强公共图书馆、流动图书馆和公共阅报栏(屏)等全民阅读设施建设,建立健全管理服务制度,为公民提供方便快捷的阅读服务。 全民阅读设施管理单位应当根据全民阅读设施的功能,向公民提供图书借阅、阅读指导、阅读能力培训、文化教育、科学普及等服务,并公示服务项目,改善服务条件,提高服务水平。 第三十六条 提倡节地生态安葬。鼓励和支持公民采用海葬、树葬等方式安葬。 第三十七条 鼓励和支持国家机关、企业事业单位、社会团体和其他组织结合自身实际,参加或者组织本单位人员参加各种文明行为评选活动。 鼓励企业对本单位职工文明行为进行表彰和奖励。 鼓励有关单位在招聘时,同等条件下优先录用、聘用道德模范、身边好人、文明市民等文明行为先进人物。 第三十八条 鼓励国家机关、企业事业单位、村民委员会、居民委员会和其他组织利用本单位场所、设施设立爱心服务点,为户外工作人员以及其他需要帮助的人员提供饮用水、饭菜加热、遮风避雨和便携设备充电等便利服务。 车站、医院、大型商场等公共场所应当配备独立的母婴室,鼓励设置双层扶手,满足特殊人群的使用需求。酒店、餐馆等公共消费场所应当设置儿童座椅,方便儿童就餐。 第三十九条 国家机关、企业事业单位、村民委员会、居民委员会、行业协会和其他组织应当制定文明守则、村规民约、社区居民文明公约、行业守则或者其他文明行为规范,将本条例规定的内容融入其中,鼓励和动员社会各方面力量参与文明行为促进工作。 第四十条 对见义勇为者、从事慈善公益或者志愿服务活动成绩显著的自然人、法人和其他组织,市、区(县级市)人民政府或者有关部门应当按照规定给予表彰和奖励。
第四章 实施与监督
第四十一条 市、区(县级市)人民政府应当加强与文明行为促进工作有关的基础设施的规划、建设和管理,加大投入。 第四十二条 市、区(县级市)精神文明建设工作机构应当开展社会文明程度指数测评工作,进行文明城市、文明单位、文明村镇、文明家庭、文明校园考评。 第四十三条 市、区(县级市)精神文明建设工作机构应当设立不文明行为曝光平台,依法对造成严重社会不良影响的不文明行为予以曝光,但不得曝光涉及国家秘密、商业秘密或者个人隐私的信息,不得曝光未成年人的个人信息。 第四十四条 公共信用信息管理部门应当加强公民文明行为信息录入公共信用信息管理系统的管理工作,并依法实施信息共享。 第四十五条 教育行政部门应当指导教育机构制定校园文明公约,加强文明校园建设,推进中华优秀传统文化教育,开展文明行为、文明礼仪教育,并将其纳入中小学校、幼儿园的教学内容。 教育行政部门和教育机构应当加强师德建设,组织和引导教师模范遵守职业道德,规范教育教学行为。 教育行政部门和教育机构应当加强法治宣传教育和心理健康教育,预防和处置校园欺凌事件,保障学生身心健康。 第四十六条 公安机关应当依法制止和查处违反社会治安管理、网络安全、扰乱公共秩序的不文明行为和违法行为。 第四十七条 公安机关交通管理、交通运输等部门应当加强文明出行宣传教育,开展城市道路交通管理常态化执法,制止不文明交通行为,查处交通违法行为。 第四十八条 民政部门应当加强移风易俗宣传教育,推进殡葬制度改革,为公民实施节地生态安葬提供便利和服务。 第四十九条 司法行政部门应当将促进文明行为的法律、法规纳入法治宣传教育范围,并推动落实。 第五十条 住房和城乡建设、规划、城市管理执法、环境保护、海洋渔业等部门应当制止城乡建设和管理中的不文明行为,依法查处破坏市容环境、违法建设、损毁公共设施、侵占绿地、污染生态环境等违法行为。 第五十一条 卫生行政部门、医疗卫生机构应当加强文明行医、文明就医宣传,加强医护人员职业道德建设,提升服务质量,加强医患沟通,维护公平有序的就医环境。 第五十二条 旅游部门应当加强文明旅游宣传教育,引导旅游经营者和旅游者自觉遵守文明旅游管理规定和行为规范,并制止不文明旅游行为,查处旅游违法行为。 第五十三条 工商、质量技术监督、食品药品监督管理、物价、商务、旅游等部门应当加强合法、诚信经营宣传,依法处理纠纷,制止不文明经营行为,依法查处欺诈消费者等违法经营行为。 第五十四条 镇人民政府、街道办事处应当开展文明乡风教育,推进移风易俗,摒弃陈规陋习。 镇人民政府、街道办事处应当指导村民委员会、居民委员会制定村规民约、社区居民文明公约,将文明行为促进与文明村、文明社区建设结合起来,增进邻里团结互助,营造和谐氛围。 第五十五条 国家机关、企业事业单位、村民委员会、居民委员会和其他组织应当对其工作场所、营业场所或者服务区域范围内发生的不文明行为进行劝阻;对属于违法行为的,应当告知有关行政管理部门予以处理。 公民有权对不文明行为进行劝阻。行为人应当听从劝阻,不得打击报复劝阻人。 第五十六条 市、区(县级市)人民政府有关部门可以聘请文明行为协管员、监督员,协助做好文明行为宣传教育和公共秩序维护等工作。 第五十七条 在查处违法的不文明行为时,行政执法人员有权要求行为人提供姓名、住址、所在单位、联系方式等基本信息。行为人拒不提供的,行政执法人员可以依照有关规定通知公安机关进行现场查验,公安机关应当依法予以配合。 第五十八条 文明行为促进工作各责任单位及其工作人员在工作中玩忽职守、滥用职权、徇私舞弊的,由其所在单位或者有关机关依法给予处分;构成犯罪的,依法追究刑事责任。 对文明行为促进工作各责任单位及其工作人员不履行或者不正确履行职责的,公民有权进行监督,并向有关机关举报。
第五章 附则
第五十九条 违反本条例规定的行为,其他法律、法规对其法律责任已有规定的,从其规定。 第六十条 本条例自2019年1月1日起施行。

The Regulations of Weihai Municipality on the Civilized Conduct Promotion, as adopted at the 11th session of the Standing Committee of the 17th People's Congress of Weihai Municipality on August 29, 2018 and approved at the 5th Session of the Standing Committee of the 13th People's Congress of Shandong Province on September 21, 2018, is hereby issued and shall come into force as of January 1, 2019.

Chapter I General Provisions Article 1 These Regulations are enacted in accordance with relevant laws and regulations and in light of actual situations of this Municipality, for the purposes of regulating and guiding the civilized conduct of citizens, cultivating and practicing core socialist values and improving the civilization level of the city and civilization quality of the citizens.
Article 2 These Regulations shall be applicable to the civilized conduct promotion within the administrative areas of this Municipality. Matters not provided for in these Regulations shall be governed by other applicable laws and regulations.
Article 3 For the purposes of these Regulations, “civilized conduct” means observing the Constitution and laws, meeting the socialist moral requirements, embodying the core socialist values, maintaining the public order and good morals, guiding the social tendency, and promote the progress of social civilization.
Article 4 The working mechanism of organization and implementation by the government, sharing of work by all parties and participation by the society shall be established for the civilized conduct promotion to ensure the continuous and effective implementation of civilized conduction promotion.
Article 5 The municipal and district (county-level city) cultural-ethical standards committees shall coordinate the civilized conduct promotionion within their respective administrative areas and the offices of spiritual civilization construction thereunder shall be responsible for the organization and implementation of civilized conduct promotion and perform the following duties: (i) drafting the planning and plans for programs and plans for civilized conduct promotion; (ii) guiding and implementing various volunteer activities; (iii) providing guidance for competent departments in various industries and industry associations in the development of industry code of conduct, and supervising the implementation of such code of conduct; (iv) directing and coordinating relevant departments in the civilized conduct promotion; (v) supervising and inspecting the implementation of civilized conduct promotion; (vi) regularly evaluating and circulating the implementation of these Regulations; (vii) directing and supervising relevant departments to accept and deal with reports and complaints as required; (viii) completing other work of civilized conduct promotion. The Municipality and districts (county-level cities) shall establish a joint meeting system for the civilized conduct promotion and coordinate agencies concerned in settlement of major issues.
Article 6 The municipal and district (county-level city) people’s governments shall include the civilized conduct promotion in the national economic and social development planning and the annual plans, develop relevant policies and measures, incorporate the funds for the civilized conduct promotion into the financial budgets and earmark such for the civilized conduct promotion. The municipal and district (county-level city) people’s governments shall make solid implementation of the civilized conduct promotion in accordance with their respective functions and duties. The town people’s governments and sub-district offices shall make solid implementation of civilized conduct promotion within their respective administrative areas. The villagers and neighborhood committees shall strengthen the propaganda and guidance of civilized conduct, and assist relevant departments in the civilized conduct promotion.
Article 7 The state organs, enterprises, public institutions, social organizations, other organizations and citizens shall participate in the civilized conduct promotion. Public servants and public figures shall play an exemplary role in the civilized conduct promotion.
Article 8 The municipal and district (county-level city) people’s governments shall establish a sound system for report, complaint, investigation and handling of uncivilized conduct, publish the phone numbers, email and other contact information for report and complaint, accept report and complaint, and investigate and handle the illegal uncivilized conducts. Any entity or individual that finds uncivilized conduct shall have the right to report and complain. Chapter II Basic Code of Conduct Article 9 Citizens shall love the country, abide by the law, be polite, honest, diligent, thrifty, professional and dedicated, respect the elderly, love the young, and observe the such code of conduct as the convention on civilized conduct for citizens, village rules, community residents' etiquette and ethical standards, and industry standards.
Article 10 Citizens shall safeguard national interests and dignity, love the national flag and national emblem, and respect the national anthem.
Article 11 Citizens shall protect the public environment and voluntarily observe the following provisions: (i) do not spit in the public environment, commit nuisance, litter garbage or dump wastewater around; (ii) do not set off fireworks in prohibited times and/or in prohibited areas, or smoke in indoor public space and other places where smoking is prohibited; (iii) do not burn straws, garbage and other wastes in the open, or have an open-air barbecue in prohibited areas; (iv) do not throw joss paper in parks, on roads, and in public areas and living quarters, or burn joss paper, things of the deceased and other articles for funeral and memorial purposes; (v) do not put up, scribble, engrave or hang advertising products on exterior walls, stairways, in elevators of buildings and/or structures or on trees, outdoor pipelines and other outdoor facilities; (vi) do not pile up or hang any article that is an eyesore on the balcony, outside the window or in other space of buildings facing the street, or throw articles out of buildings and structures; (vii) do not set up stalls at unapproved times and in unapproved places, or occupy roads without permission; (viii) merchants in bazaars, convenience service places and mobile booths shall keep the surrounding area clean; (ix) keep the restroom clean and neat, and do not scribble or engrave uncivilized words or drawings on walls and other facilities in public lavatory; and (x) observe other provisions on public environment sanitary management and code of conduct. Any citizen violating Item (i) of Paragraph 1 of this Article shall be dissuaded and stopped by the administrators and civilized conduct officers (inspectors) of the public site; failing which the circumstance shall be reported to the urban administration and law enforcement department for disposal. The urban administration and law enforcement department shall criticize and educate the citizen concerned and order the citizen to remove the pollutants; where the citizen concerned refuses to make rectification, a fine of no more than RMB 200 shall be imposed. Any citizen, in violation of Item (iv) of Paragraph 1 of this Article, throwing joss paper or burning joss paper, things of the deceased and other funeral and memorial articles in parks, on roads and other public places nearby shall be dissuaded and stopped by the administrators and civilized conduct officers (inspectors) of the public site; failing which the circumstance shall be reported to the urban administration and law enforcement department for disposal. The urban administration and law enforcement department shall criticize and educate the citizen concerned and order the citizen to stop the illegal acts, order to recover the joss paper or things so thrown, and clean the polluted area; where the citizen concerned refuses to make rectification, a fine of no more than RMB 50 shall be imposed on the citizen throwing joss paper; a fine of no more than RMB 1,000 and no less than RMB 2,000 on the citizen burning joss paper, things of the deceased and other funeral and memorial articles . Any citizen, in violation of Item (vi) of Paragraph 1 of this Article, throwing articles out of buildings and structures shall be dissuaded and stopped by the administrators and civilized conduct officers (inspectors) of the public site; failing which the circumstance shall be reported to the urban administration and law enforcement department for disposal. The urban administration and law enforcement department shall criticize and educate the citizen concerned and order the citizen to stop the illegal acts, and a fine of no more than RMB 50 and no less than RMB 200 shall be imposed; where any severe circumstances is caused, a fine of no less than RMB 200 and no more than RMB 2,000 shall be imposed.
Article 12 Citizens shall observe public order and voluntarily abide by the following provisions: (i) dress neatly, have good manners, and make no noise and use no bad language in the public places; (ii) buy goods and wait for services in line, let passengers get off first when using elevators, use the escalator orderly, yield the right of way to the elder, women, children and the disabled, and shall not jump, play boisterously, or hit the elevator when taking elevators; (iii) choose appropriate time and place for commercial promotion, entertainment, exercise and other activities, and control the volume if any audio equipment is used so that others' work and life will not be affected; (iv) choose safe place for such exercises as playing of iron whip and throwing of darts and do not jeopardize the safety of others; (v) fly no kite or drone in such densely populated areas as places around airports, railways and power lines and living quarters; (vi) regulate the dog-raising to prevent the pet dog from affecting the normal life of others, and take safety and sanitation measures when the dog is taken outdoors; (vii) protect public facilities and not damage flowers, grasses and trees; and (viii) observe other provisions of public order and code of conduct. Any citizen, in violation of Item (ii) of Paragraph 1 of this Article, jumping and playing in or hitting the elevator shall be dissuaded and stopped by the owner, user or safety manager of the elevator; where the citizen refuses to make rectification upon dissuasion, be reported to the public security organ for disposal. The public security organ shall criticize and educate the citizen concerned and order the citizen to make rectification; where the citizen concerned refuses to make rectification, a fine of no more than RMB 200 and no less than RMB 500 shall be imposed. Any citizen violating Item (iv) of Paragraph 1 of this Article shall be dissuaded and stopped by the owner, user or safety manager of the elevator; where the citizen refuses to make rectification upon dissuasion, be reported to the public security organ for disposal. The public security organ shall criticize and educate the citizen concerned and order the citizen to make rectification; where the citizen concerned refuses to make rectification, a fine of no more than RMB 200 and no less than RMB 500 shall be imposed.
Article 13 All citizens shall protect the ecological environment, live a green and low-carbon life, reduce the use of plastic bags and disposable products, and reasonably use package. All citizens shall conserve natural resources and shall be encouraged to use energy-saving products, water-saving products, and products made with recycled materials, and make sorted collection and throwing of household waste. It is advised to have good table manners and dining etiquette, to eat healthily, and not waste food.
Article 14 The drivers of motor and non-motor vehicles shall observe road traffic safety laws and regulations and drive in a civilized manner. The motor vehicle drivers shall conscientiously not throw waste out of the vehicle and teach the passenger to do so; slow down before reaching pedestrian passageways, yield the right of way to pedestrians, and use the light and horn in accordance with law, and shall not use hand-held cell phone, overtake, use the emergency lane, or cover the fire hydrant. The vehicle shall be parked orderly. The non-motor vehicles shall be driven in the non-motor vehicle lane or the right-hand lane for motor vehicle, but shall not be on the wrong side or side by side with other vehicles. The passengers of public transportation shall abide by applicable rules, get on and off the vehicle orderly, offer their seats to the elderly, children, the sick, the disabled, the pregnant, and passengers carrying baby in their arms, and not carry inflammable and explosive goods and articles with unpleasant odor. The elderly shall be encouraged to avoid rush hours to take public transit. Pedestrians shall walk through the crossroad or cross the road in accordance with regulations, use the pedestrian passageway and walk quickly, and shall not stride over road separation facilities. The users of shared vehicles shall observe the service agreement and shall not damage, destroy, usurp or modify shared vehicles, or park or put shared vehicles disorderly.
Article 15 Citizens shall travel with civility and voluntarily observe the following provisions: (i) protect the cultural relics and historical sites, and respect local customs, habits and religious beliefs; (ii) do not participate in activities that insult national dignity and harm the nation's feelings or take photos or record videos in violation of regulations; (iii) follow the guidance and management of scenic spots, and do not engage in any activity endangering personal and property safety and such safety of others; (iv) do not climb, scribble or engrave on buildings, structures, public facilities and trees in scenic spots; (v) observe other provisions on civilized travel and code of conduct.
Article 16 Citizens shall be civilized online and shall not fabricate or disseminate false information, insult or vilify others through posts, comment threads or other manners, post or forward photos or videos containing bloody images of traffic accidents, fire or other disaster scenes or harming the people's feelings, or allow minors to enter the premises of Internet surfing service.
Article 17 Citizens shall be committed to his job, observe professional ethics, work systems and standard operation procedures, respect service recipients, and strive to improve service quality. The service window staff shall use polite language and standard phrases, and provide warm and thoughtful service. Citizens shall conscientiously perform their statutory and agreed obligations and act honestly and ethically. Business operators shall run business duly and honestly and have goods clearly priced, and shall not cheat or mislead consumers, make false advertisement, palm off shoddy goods as quality goods, sell unqualified products, or force others to buy or sell.
Article 18 Citizens shall obey community code of civilized conduct and conscientiously observe the following provisions: (i) live in harmony with neighbors, work in unity and help each other, protect and reasonably use public space and facilities, and participate in public welfare activities organized by buildings and communities; (ii) do not establish buildings and structures, park or place vehicles disorderly, or block the fire passage illegally; (iii) do not disturb the normal life of others in house decoration, or decorate house in a manner that the safety of the building is affected; (iv) do not occupy public greenbelts, lawns or other public space to plant vegetables, fruit trees and other crops, or use public space to pile up articles and raise livestock, poultry or other animals; and (v) other community property management provisions and code of conduct.
Article 19 Family members shall respect the elderly, love the young, support and respect each other, treat each other equally, foster and carry forward family traditions. The supporter shall be obliged to provide economic support, life care and spiritual comfort to the elderly; the supporter not living with the elderly shall regularly visit or extend greetings by phone or the Internet; the supporter shall respect the elderly’s freedom of marriage and shall not interfere with their divorce, remarriage and married life. Parents and other guardians shall discharge their guardianship responsibilities and maintenance obligations for the underaged children. Family members shall be obliged to support the disabled member and encourage and help the disabled to enhance the self-reliance ability.
Article 20 Citizens shall respect teachers, value education, and assist teachers with education and cultivation of students and shall not interfere with education and teaching order by any means.
Article 21 Citizens shall have good manners when seeing a doctor, and respect the laws of medicine and the medical staff, and shall not insult, vilify, threat or beat any medical staff, or gather a crowd to arouse disturbances in medical premises.
Article 22 Citizens shall choose a safe zone within the designated area for such activities in touch with the sea as fishing or excursion and shall not damage marine resources and the ecological environment.
Article 23 Citizens shall care for and respect the heroes, martyrs, servicemen and their families and shall not insult heroes, martyrs and soldiers in any form.
Article 24 It is encouraged to change outdated social morals, and follow good and new-style practices and trends of weddings, funerals and memorial ceremonies.
Article 25 Citizens shall treat people from another place with warmth and sincerity and provide assistance within their own capacity.
Chapter III Encouragement and Promotion Article 26 The municipal and district (county-level city) people’s governments and relevant departments shall put in a place a commendation and reward system for civilized conduct, develop policies to care for role models, good people at grassroots level, civilized residents of the city and other advanced individuals with civilized conduct, and resolve difficulties therefor.
Article 27 The municipal and district (county-level city) ethical standards agencies and relevant departments shall publicize the norms, etiquette and typical examples of civilized conduct and strive to create a good atmosphere where civilized conduct is encouraged and promoted. Public media including newspapers, radio, TV, and the Internet shall promote typical examples of civilized conduct, publish or broadcast public service advertisements, and expose uncivilized conduct. We media shall be encouraged to publish and promote positive propaganda materials like polite language and videos. The units and individuals shall be encouraged, supported and guided to take part in the promotion of civilized conduct by providing funds, technologies, labor and intellectual achievements, and otherwise.
Article 28 Relevant departments of the municipal and district (county-level city) people’s governments or social organizations shall establish the civilized conduct files, record citizens' participation in charity activities, volunteer services, brave action for a just cause, propaganda and education of civilized conduct, and other activities as the basis for commendation and rewards, and include such records in the public credit information management system.
Article 29 The units and individuals shall be encouraged to carry out such charity activities as disaster relief donations, poverty alleviation, aid to the disabled, rescue of the orphaned, relief to those in need, assistance to the aged, financial aid to students, and medical aid to help the disadvantaged and vulnerable groups. Article 30 Citizens shall be encouraged to act bravely for a just cause according to their own capability. The units and individuals shall support the brave act for a just cause and respect and protect the actor concerned. Where necessary, assistance shall be provided to the actor and the close relatives thereof.
Article 31 Citizens shall be encouraged to donate blood without payment and voluntarily donate hematopoietic stem cells, cadavers and organs; the medical institutions and medical staff shall give medical treatment to donor's cadaver in accordance with the ethical principles to maintain the donor's dignity. Unpaid blood donors and their spouses and immediate family members shall have priority and preferential treatment in accordance with law when using blood.
Article 32 It shall be encouraged and supported to establish various volunteer service organizations, expand the fields of volunteer services, and launch diversified volunteer service activities. Employers shall support their employees to participate in volunteer service activities. The volunteer service commendation and reward systems shall be established and completed to guarantee the legitimate rights and interests of the volunteers. Volunteers may, in case of encountering any difficulty, apply for prioritized obtainment of volunteer services.
Article 33 Citizens shall be encouraged, supported and protected to give first aid or provide necessary help to those who need emergency aid.
Article 34 The whole society shall be encouraged to care for the empty-nest elderly, left-behind children, households that lose their only child, the disabled, and underage children of migrant workers. Relevant departments shall strengthen the supervision and guidance of home guardianship and authorized guardianship. The municipal and district (county-level city) people’s governments and relevant departments shall take measures to provide employment, children's schooling, legal aid and other services to migrant workers, and improve migrant workers' identical treatment to enhance their sense of identity and belonging.
Article 35 All citizens shall be encouraged and supported to read books. The municipal and district (county-level city) people’s governments and relevant departments shall enhance the construction of public libraries, mobile libraries, public newspaper stands (screens), and other reading facilities, establish and complete the management service system, and provide convenient and efficient reading services to citizens. The administration units of national reading facilities shall provide such services as book borrowing, reading instructions, reading skill training, cultural education, science popularization and otherwise, publicize service items, improve the service conditions and enhance the service quality.
Article 36 The land-conserving and eco-friendly burials shall be advocated. Citizens shall be encouraged and supported to adopt burial at sea, tree burial, and other forms of burial.
Article 37 The state organs, enterprises, public institutions, social organizations and other organizations shall be encouraged and supported to participate in or organize their staff to participate in various civilized conduct contests in light of their actual situations. Enterprises shall be encouraged to commend and reward employees for civilized conduct. The employers shall be encouraged to give priority to advanced figures with civilized conduct such as role models, good people at grassroots level, and civilized residents of the city, under same conditions in recruitment.
Article 38 The state organs, enterprises, public institutions, villagers committees, neighborhood committees, and other organizations shall be encouraged to use their venues and facilities to set up giving stations and provide such convenience services as drinking water, food heating, shelters, and portable charging devices for outdoor staff and other people who need help. The traffic stations, hospitals, shopping malls and other public spaces shall be equipped with independent nursing rooms and be encouraged to install double handrails to meet special needs. The hotels, restaurants, and other public consumption facilities shall have child safety seats to facilitate children in dining.
Article 39 The state organs, enterprises, public institutions, villagers committees, neighborhood committees, industry associations and other organizations shall develop etiquette and ethical standards, village rules, community residents' ethical standards, industry standards or other code of civilized conduct, incorporate provisions of these Regulations into such standards and rules, and encourage and mobilize all social sectors to participate in the civilized conduct promotion.
Article 40 The municipal and district (county-level city) people’s governments or relevant departments shall commend and reward those who act bravely for a just cause, and natural persons, legal persons and other organizations that make remarkable achievements in public welfare or volunteer service activities as required.
Chapter IV Implementation and Supervision Article 41 The municipal and district (county-level city) people’s governments shall strengthen the planning, construction and administration of infrastructure in relation to the civilized conduct promotion and increase the investment thereto.
Article 42 The municipal and district (county-level city) spiritual civilization construction agencies shall carry out evaluation on the social civilization degree and assessment of civilized cities, civilized units, civilized villages and towns, civilized families, and civilized campuses.
Article 43 The municipal and district (county-level city) spiritual civilization construction agencies shall establish an uncivilized conduct exposure platform and expose uncivilized conduct causing materially adverse social impact, except information involving state secrets, trade secrets or personal privacy, and personal information of minors.
Article 44 The public credit information administration department shall strengthen the administration on inputting the citizens' civilized conduct into the public credit information management system, and share the information in accordance with law.
Article 45 The education department shall guide the educational institutions in developing campus civility convention, enhance the construction of civilized campus, promote the education of fine traditional Chinese culture, carry out education of civilized conduct, civility and etiquette, and include such in the teaching contents for primary and middle schools and kindergartens. The education department and educational institutions shall strive to raise teaching ethical standards, organize and guide teachers to play an exemplary role in obeying professional ethics, and standardize educational and teaching conduct. The education department and educational institutions shall strengthen the promotion and education of the legal system and mental health, prevent and deal with campus bullying, and ensure that students are healthy physically and mentally.
Article 46 The public security organ shall stop and punish uncivilized conduct and illegal act in violation of the public security administration and cybersecurity regulations or disturb public order.
Article 47 The traffic administration and transportation departments under the public security agencies shall strengthen the promotion and education of civilized travel, carry out normalized law enforcement in urban road traffic administration, stop uncivilized traffic behavior, and punish traffic offenses.
Article 48 The civil affairs department shall strengthen the promotion and education of changes in outdated in habits and customs, promote the reform of funeral and interment systems, and provide convenience and services for citizens to carry out land-conserving and eco-friendly burial.
Article 49 The judicial department shall promote the inclusion of laws and regulations on civilized conduct into the promotion and education of rule of law, and push forward the implementation thereof.
Article 50 The departments of housing and urban-rural construction, planning, urban administration and law enforcement, environmental protection, ocean and fisheries, and otherwise shall stop uncivilized conduct in urban-rural construction and administration and investigate and punish such illegal acts as damage to city appearance and environment, illegal construction, destruction of public facilities, occupation of greenbelts, and pollution of ecological environment.
Article 51 The health departments and medical institutions shall strengthen the promotion of civilized practice of medical service and civilized conduct in seeking medical treatment, enhance the medical staff's professional ethics, improve service quality, strengthen communication, and maintain a fair and orderly environment for medical services.
Article 52 The tourism department shall reinforce the promotion and education of civilized traveling, guide tourism operators and travelers to conscientiously obey civilized travel management provisions and code of conduct, stop uncivilized traveling, and punish violations in tourism.
Article 53 The departments of industry and commerce, quality and technical supervision, food and drug administration, price control, commerce, tourism and otherwise shall promote the lawful and good-faith operations, handle disputes according to law, stop uncivilized operations, and punish illegal operations like defrauding consumers.
Article 54 The town people’s governments and sub-district offices shall carry out education of civilized local customs, promote the change of outdated social morals, and discard outdated conventions and detestable customs. The town people’s governments and sub-district offices shall guide the villagers committees and neighborhood committees in developing local rules and community residents' ethical standards, incorporate the civilized conduct promotion into the development of civilized villages and civilized communities, promote solidarity and mutual aid in neighborhood, and foster a harmonious atmosphere.
Article 55 The state organs, enterprises, public institutions, villagers committees, neighborhood committees, and other organizations shall dissuade uncivilized conduct in their workplace, premises or service areas; and report to relevant departments where such civilized conduct violates any law or regulation. Citizens shall have the right to dissuade uncivilized conduct. The actor concerned shall accept the dissuasion and shall not retaliate against the person who dissuades the uncivilized conduct.
Article 56 Relevant departments under the municipal and district (county-level city) people’s governments shall hire the civilized conduct officers and inspectors to help with the promotion and education of civilized conduct and maintenance of public order.
Article 57 When investigating and handling uncivilized conduct in violation of laws and regulations, the law enforcement officer shall have the right to request the actor concerned to provide his name, home address, employer, contact information, and other general information. Where the actor refuses to provide the foregoing information, the law enforcement officer may notify the public security organ of on-site verification in accordance with relevant regulations, and the public security agency shall cooperate in accordance with law.
Article 58 Any unit responsible for the civilized conduct promotion or the staff thereof conducting abuse of power, neglect of duty and play of favoritism and commission of irregularities shall be sanctioned by the unit concerned or relevant departments; where any crime is constituted, criminal liabilities shall be investigated in accordance with law. Any unit responsible for the civilized conduct promotion or the staff thereof failing to preform or correctly perform corresponding functions and duties, citizens shall have the right to supervise and report to the relevant departments.
Chapter V Supplementary Provisions Article 59 Where any law or regulation have provided for the legal liability for violations of these Regulations, such law or regulation shall prevail.
Article 60 These Regulations shall come into force as of January 1, 2019.
