威海市饮用水水源地保护条例

第一章  总  则

 

第一条  为了加强饮用水水源地保护,保障饮用水水质安全,根据《中华人民共和国水法》《中华人民共和国水污染防治法》《山东省水污染防治条例》等有关法律、法规,结合本市实际,制定本条例。

第二条  本条例适用于本市行政区域内饮用水水源地的保护与管理工作。

第三条  本条例所称饮用水水源地,是指通过城镇公共供水管网向城镇提供生活饮用水的地表水水源地。

实行分散供水的农村饮用水水源地的保护与管理,依照有关法律、法规的规定执行。

第四条  饮用水水源地保护应当遵循科学规划、综合治理、防治结合、确保安全的原则。

第五条  市、区(县级市)人民政府负责本行政区域内饮用水水源地保护工作,将饮用水水源地保护纳入国民经济和社会发展规划、年度计划,建立完善环境保护目标考核体系,将饮用水水源地保护经费纳入同级财政预算,加大财政投入,促进经济建设和饮用水水源地保护协调发展。

第六条  市、区(县级市)生态环境行政主管部门负责本行政区域水功能区划的编制和饮用水水源地污染防治的统一监督管理。

市、区(县级市)水行政主管部门负责饮用水水源地工程的建设管理工作。

市、区(县级市)农业农村行政主管部门负责本行政区域内饮用水水源地畜禽养殖废弃物综合利用的指导、服务工作。

市、区(县级市)自然资源行政主管部门负责本行政区域内饮用水水源保护区建设项目用地和矿产资源开采审批,以及土地利用的监督管理工作。

市、区(县级市)林业行政主管部门负责本行政区域内饮用水水源地水源涵养林、护岸林的规划和建设管理以及退耕还林政策的制定工作。

各级发展改革、公安、财政、住房城乡建设、城市管理、卫生健康等部门,应当按照各自职责做好饮用水水源地保护工作。

第七条  饮用水水源流域范围内的镇人民政府、街道办事处应当依法做好本辖区内饮用水水源的保护工作。

鼓励村(居)民委员会在村规民约或者居民公约中规定村(居)民保护饮用水水源地的义务,落实保护措施。

第八条  市、区(县级市)人民政府和有关部门应当组织开展饮用水水源地保护的宣传教育,普及饮用水水源地保护的法律法规和科学知识,提高公众保护饮用水水源地的意识。

报刊、广播、电视、网络等媒体应当积极开展饮用水水源地保护的公益宣传。

第九条  任何单位和个人都有保护饮用水水源地的义务,有权对破坏和污染饮用水水源地的行为进行举报,接受举报的部门应当依法调查处理。

市、区(县级市)人民政府对在饮用水水源地保护方面做出显著成绩的单位、个人给予表彰和奖励。


第二章  保护区的划定

 

第十条  市、区(县级市)人民政府应当根据本行政区域内经济社会发展需要和水资源开发利用现状,按照优先保障居民生活饮用水的原则,统筹规划确定饮用水水源地并向社会公布。

第十一条  市、区(县级市)人民政府应当依法划定一定范围的水域、陆域作为饮用水水源保护区,报请山东省人民政府批准后公布。

饮用水水源保护区划分为一级保护区、二级保护区。在饮用水水源保护区以外划定准保护区。

第十二条  饮用水水源保护区划定后,因公共利益需要、自然环境发生变化等情况需要调整或者取消的,按照原批准程序重新报请批准后公布。

第十三条  市、区(县级市)人民政府应当在饮用水水源保护区边界设立明显的地理界标和警示标志,并在饮用水水源一级保护区重点地段设置隔离防护设施。

任何单位和个人不得损毁、涂改或者擅自移动地理界标、警示标志和隔离防护设施。

 

第三章 保护措施

 

第十四条  禁止在饮用水水源准保护区内从事下列活动:

(一)新建、改建、扩建有严重水污染隐患或者其他对水体可能产生污染并且无有效防治措施的建设项目;

(二)影响饮用水水源地水质的矿产勘查、开采活动;

    (三)丢弃农药包装物、反光膜等农用生产资料产品废弃物或者清洗施药器械;

    (四)使用剧毒、高毒和高残留农药;

    (五)使用炸药、毒品、化学药品捕杀鱼类;

    (六)倾倒或者填埋工业废弃物、医疗垃圾等有毒、有害废弃物;

    (七)向水域倾倒生活垃圾、粪便以及其他废弃物;

(八)在水体中清洗装贮过油类或者有毒有害污染物的车辆和器具;

(九)破坏湿地,破坏水源涵养林、护岸林等与水源保护相关植被的行为;

(十)法律、法规禁止的其他行为。

第十五条  禁止在饮用水水源二级保护区内从事下列活动:

(一)新建、改建、扩建排放污染物的建设项目;

(二)设置排污口;

(三)新建、扩建畜禽养殖场、养殖小区和养殖专业户;

(四)建设工业固体废物集中贮存、处置设施、场所或者生活垃圾填埋场;

(五)设立装卸垃圾、粪便、油类和有毒物品的码头;

(六)围垦河道、滩地,或者在河道、水库等采石、采砂、取土、弃置砂石;

(七)法律、法规禁止的其他行为和本条例第十四条禁止的行为。

已建成排放污染物的建设项目,由有管辖权的人民政府依法责令拆除或者关闭,并进行生态修复。

第十六条  禁止在饮用水水源一级保护区内从事下列活动:

(一)新建、改建、扩建与供水设施和保护水源无关的项目和设施;

(二)设置与供水需要无关的码头;

(三)非水源涵养林或者护岸林种植、畜禽放养、网箱养殖;

(四)爆破、打井、挖沙、放牧、建墓、丢弃和掩埋动物尸体;

(五)非供水、防汛或者水源保护使用的船只、排筏以及各类自制工具航行、停泊或者作业;

(六)洗刷车辆、衣物和其他器具;

(七)组织旅游、水上训练、露营、野炊;

(八)游泳、垂钓、放生;

(九)法律、法规禁止的其他行为和本条例第十五条禁止的行为。

已建成的与供水设施和保护水源无关的建设项目和设施,由有管辖权的人民政府依法责令拆除或者关闭,并进行生态修复。

第十七条  严禁运输危险化学品、危险废物等有毒有害物质的车辆擅自驶入饮用水水源保护区;确需驶入的,应当报经县级人民政府公安机关批准。运输车辆应当悬挂明显标志并采取有效的防溢、防漏、防扩散等措施。

县级人民政府公安机关应当划定限制装载有毒有害物质车辆通行的区域,并设置明显标志。

第十八条  饮用水水源二级保护区内的畜禽养殖专业户、散养户应当采取必要的污染防治措施,妥善处理畜禽养殖废弃物,达到防渗、防雨、防溢流要求。

第十九条  饮用水水源一级保护区内居民应当实施搬迁,具体搬迁方案由市人民政府组织制定。

第二十条  各级人民政府应当加强农村环境综合整治,完善生活污水、垃圾和病死畜禽的集中收集处理体系,防止污染水源。

第二十一条  各级人民政府应当落实河长制,建立健全河道污染管控机制。

第二十二条  市、区(县级市)人民政府农业农村行政主管部门应当采取有效措施,指导农业生产者科学、合理施用化肥和农药,推广测土配方施肥技术和高效低毒低残留农药,控制化肥和农药的过量使用,降低农业面源污染。

饮用水水源流域范围内的农业生产者应当按照有关规定,安全、合理使用化肥和农药,采用新技术和病虫害综合防治技术,减少化肥和农药的使用量。

第二十三条  区、县级市人民政府应当在饮用水水源保护区建立农药包装物、反光膜等污染水源农用生产资料产品废弃物的回收制度,具体办法由各区、县级市人民政府根据本地区实际情况制定。

第二十四条  区、县级市人民政府应当在饮用水水源保护区范围内设立水源保护协管员队伍,建立定期巡查制度,协助相关部门做好饮用水水源保护工作。

第二十五条  市、区(县级市)人民政府林业行政主管部门应当加强饮用水水源保护区和准保护区内水源涵养林、护岸林的建设管理,保护地被植物,保持水土平衡,防止河流、水库淤塞。

第二十六条  饮用水水源一级保护区实行退耕还林。市、区(县级市)人民政府应当制定退耕还林实施方案,并组织实施。

第二十七条  市、区(县级市)人民政府应当建立健全饮用水保护专项补偿机制。具体补偿方式、范围、对象和标准,由市人民政府组织制定。

第二十八条  市、区(县级市)人民政府应当组织生态环境等部门,对饮用水水源保护区和供水单位周边区域的环境状况和污染风险定期进行调查评估,筛查可能存在的污染风险因素,并采取相应的风险防范措施。

第二十九条  市、区(县级市)生态环境行政主管部门、水文机构应当依法做好饮用水水源地水质监测工作,并及时向社会公开饮用水水源地水质状况信息。

第三十条  市、区(县级市)人民政府以及生态环境、水行政主管部门应当制定饮用水水源地突发水污染事故应急预案,建设应急物资储备库,完善预警机制和保障措施。

供水单位应当编制饮用水水源污染应急预案,储备应急物资,建立应急处置机构,报有管辖权的市、区(县级市)人民政府备案,并定期进行应急演练。

饮用水水源保护区内单位应当编制本单位突发水污染事故应急预案,定期进行应急演练。

第三十一条  饮用水水源发生水污染事故,或者发生其他可能影响饮用水安全的突发性事件,饮用水水源地管理机构、供水单位应当采取应急处理措施,及时向有管辖权的市、区(县级市)人民政府和生态环境、水行政主管部门报告,并依法向社会公开。有关市、区(县级市)人民政府和生态环境、水行政主管部门应当根据情况及时启动应急预案,采取有效措施,保障饮用水安全。

 

第四章  法律责任

 

第三十二条  违反本条例规定的行为,法律、法规已经规定法律责任的,从其规定。

第三十三条  市、区(县级市)人民政府或者有关部门及其工作人员有下列行为之一的,对直接负责的主管人员和其他直接责任人员依法给予处分:

(一)未依法划定或者调整饮用水水源保护区的;

(二)发现破坏、污染饮用水水源的违法行为,或者接到违法行为的举报后不及时查处的;

(三)不依法作出行政许可或者办理批准文件的;

(四)未按照规定设立地理界标、警示标志或者设置隔离防护设施的;

(五)未依法做好饮用水水源地水质监测工作,并及时向社会公开水质状况信息的;

(六)未按照规定制定饮用水水源地突发水污染事故应急预案的;

(七)其他滥用职权、玩忽职守、徇私舞弊的行为。

第三十四条  违反本条例第十三条第二款规定,故意涂改或者擅自移动地理界标、警示标志、隔离防护设施的,由公安机关责令限期改正,处一千元以上一万元以下罚款。

第三十五条  违反本条例第十四条、第十五条、第十六条规定,在饮用水水源准保护区和保护区内新建、改建、扩建有严重水污染隐患的建设项目的,由生态环境行政主管部门报经有批准权的人民政府批准,责令限期拆除或者关闭,并处二十万元以上五十万元以下罚款;新建、改建、扩建其他对水体可能产生污染并且无有效防治措施的建设项目的,由生态环境行政主管部门报经有批准权的人民政府批准,责令限期拆除或者关闭,并处十万元以上二十万元以下罚款。

第三十六条  违反本条例第十四条、第十五条、第十六条规定,在饮用水水源准保护区和保护区内丢弃农药包装物、反光膜等农用生产资料产品废弃物或者清洗施药器械的,由农业农村行政主管部门责令限期改正,丢弃者为农产品生产企业、从事农产品生产的农民专业合作社等单位的,处五万元以上十万元以下罚款,丢弃者为个人的,可以处二百元以上二千元以下罚款;构成犯罪的,依法追究刑事责任。

第三十七条  违反本条例第十四条、第十五条、第十六条规定,在饮用水水源准保护区和保护区内使用剧毒、高毒和高残留农药的,由农业农村行政主管部门责令限期改正,农药使用者为农产品生产企业、从事农产品生产的农民专业合作社等单位的,处十万元罚款,农药使用者为个人的,处一万元罚款;构成犯罪的,依法追究刑事责任。

第三十八条  违反本条例第十四条、第十五条、第十六条规定,向饮用水水源准保护区和保护区内倾倒或者填埋工业废弃物、医疗垃圾等有毒、有害废弃物的,由生态环境行政主管部门责令限期改正,处十万元以上二十万元以下罚款;构成犯罪的,依法追究刑事责任。

第三十九条  违反本条例第十五条、第十六条规定,在饮用水水源保护区内新建、扩建畜禽养殖专业户的,由生态环境行政主管部门报经有批准权的人民政府批准,责令限期拆除或者关闭,并处二万元以上十万元以下罚款。

第四十条  违反本条例第十八条规定,饮用水水源二级保护区内的畜禽养殖专业户、散养户未采取必要的污染防治措施,妥善处理畜禽养殖废弃物的,由生态环境行政主管部门责令限期改正,对畜禽养殖专业户处三千元以上三万元以下罚款,对畜禽散养户可以处三千元以下罚款。

第四十一条  违反本条例第十四条、第十五条、第十六条规定,违法行为发生在饮用水水源一级保护区水面的,行政主管部门可以委托符合条件的饮用水水源地管理机构进行处罚。

 

第五章   附  则

 

第四十二条  本条例自2017年11月1日起施行。

Chapter I General Provisions

Article 1 These Regulations are enacted in accordance with the Water Law of the People’s Republic of China, Water Pollution Prevention and Control Law of the People’s Republic of China, Regulations of Shandong Province on Water Pollution Prevention and Control, and relevant laws and regulations and in light of actual situations of this Municipality, for the purposes of strengthening the protection of drinking water sources and ensuring the safety of drinking water quality.

 

Article 2 These Regulations shall be applicable to the protection and management of the drinking water sources within the administrative areas of this Municipality.

 

Article 3 For the purpose of these Regulations, “drinking water sources” shall refer to the surface water sources which supply drinking water to urban households through the municipal public water system.

The protection and management of drinking water sources in rural areas with separate water supply shall be implemented in accordance with relevant laws and regulations.

 

Article 4 The protection of drinking water sources shall follow the principles of scientific planning, comprehensive administration, combination of prevention with administration, and guarantee of safety.

 

Article 5 The municipal and district (county-level city) people’s governments shall be responsible for the protection of drinking water sources within their administrative areas, incorporate the drinking water sources protection into the national economic and social development planning and the annual plans, develop and improve the goal-based evaluation system for environmental protection, incorporate the expenditures of drinking water sources protection into the fiscal budget at the same level, increase the financial input, and promote the coordinated development of economic construction and drinking water sources protection.

 

Article 6 The municipal and district (county-level city) ecological environment departments shall be responsible for the formulation of water function divisions and the unified supervision and administration on prevention and control of drinking water resources pollution within their respective administrative areas.

The municipal and district (county-level city) water departments shall be responsible for the administration on construction of drinking water resources projects.

The municipal and district (county-level city) agriculture and rural administration department shall be responsible for the guidance and services for comprehensive utilizations of wastes generated by animal husbandry within their respective administrative areas.

The municipal and district (county-level city) natural resources department shall be responsible for the the approval of land use for construction projects and exploitation of mineral resources and the supervision and administration of land use in the protected areas of drinking water sources within their respective administrative areas.

The municipal and district (county-level city) forestry department shall be responsible for the planning, construction and management of water conservation forests and bank protection forests and the formulation of the policy of restoring farmland to forests within their respective administrative areas.

The departments of development and reform, public security, finance, housing and urban-rural development, planning, urban management and law enforcement, health and family planning at all levels shall, in accordance with their respective functions and duties, make solid implementation of the drinking water sources protection.

 

Article 7 The town people’s governments and sub-district offices within the watershed of the drinking water sources shall make solid implementation of the drinking water sources protection within their jurisdictions in accordance with the law.

The villagers’ (residents’) committees shall be encouraged to provide for the obligation of villagers (residents) to protect drinking water sources in their self-governing charters, and implement protective measures.

 

Article 8 The municipal and district (county-level city) people’s governments and relevant departments shall conduct promotion and education of, popularize relevant laws and regulations and scientific knowledge of, and raise the public awareness of drinking water sources protection.

Newspapers, broadcasts, televisions, internet and other media shall actively engage in the non-profit promotion of drinking water sources protection.

 

Article 9 All units and individuals shall have the obligation to protect drinking water sources, and shall have the right to report to any act damaging or polluting drinking water sources to the competent departments, which shall carry out investigation and disposal thereof in accordance with law.

The municipal and district (county-level city) people’s governments shall commend or reward entities or individuals that have made exceptional contributions to the protection of drinking water sources.

 

Chapter  Delimitation of Protected Areas

Article 10 The municipal and district (county-level city) people’s governments shall, in light of the needs of economic and social development and the actual situations of water resources utilization within their respective administrative areas and in accordance with the principle of prioritizing the supply of drinking water for household use, make overall planning for determination of drinking water sources within their respective administrative regions and make announcement to the general public.

 

Article 11 The municipal and district (county-level city) people’s governments shall delimit certain water and land areas as the drinking water source reserves in accordance with law, and release to the public upon being approved by the people’s government of Shandong Province.

The protected areas of drinking water sources shall be classified into Grade I and Grade  reserves. Certain areas outside of aforementioned reserves may be designated as quasi-reserves.

 

Article 12 Where the delimitation of drinking water source reserves needs to be adjusted or cancelled due to the public interest or changes of the natural environment, it shall be submitted for approval in accordance with the original approval procedures and released the public thereafter.

 

Article 13 The municipal and district (county-level city) people’s governments shall establish conspicuous landmarks and warning signs at the boundaries of drinking water sources reserves and isolation protection facilities in the key areas of Grade I drinking water source reserves.

No unit or individual may damage, deface or arbitrarily remove any landmark, warning sign or isolation protection facility.

 

Chapter  Protection Measures

Article 14 The following activities shall be prohibited within the quasi-reserves of drinking water resources:

(i) carrying out new construction, reconstruction and expansion of construction projects with severe water pollution risks or that may cause water pollution with no effective prevention measures;

(ii) carrying out mineral exploration and mining activities detrimental to the water quality of drinking water sources;

(ii) discarding pesticide packages, reflective strips or other wastes from farming material products, or cleaning equipment of pesticide application;

(iv) using extreme-toxic, high-toxic or high-persistent pesticides;

(v) using bombs, poisons or chemicals for fishing;

(vi) dumping or landfilling industrial wastes, medical wastes, or other toxic wastes;

(vii) dumping household wastes, excrement or other kinds of wastes into water;

(viii) cleaning vehicles or containers that have been used to hold oily materials or toxic or harmful pollutants in the water body;

(ix) destroying wetlands, water conservation forests, bank protection forests, or other vegetation of water sources protection;

(x) other activities prohibited by relevant laws and regulations.

 

Article 15 The following activities shall be prohibited within the Grade  reserves:

(i) carrying out new construction, reconstruction and expansion of construction projects discharging pollutants;

(ii) setting up pollutant discharge outlets;

(iii) carrying out new construction or expansion of livestock and poultry farms, farming communities and professional breeding households;

(iv) establishing facilities and sites for concentrated storage and disposal of solid industrial wastes or landfill for domestic wastes;

(v) establishing ports for loading and unloading of wastes, excrement, oil and toxic substances;

(vi) reclaiming riverway and bottomland or carrying out quarrying, sand excavation, earth collection, or sand dump at the riverway and bottomland;

(vii) other activities prohibited by relevant laws and regulations and Article 14 of these Regulations.

Any built-up construction project that discharges pollutants shall be ordered by the competent people’s government to dismantle or shut down and carry out restoration of the ecosystem.

 

Article 16 The following activities shall be prohibited within the Grade I reserves:

(i) carry out new construction, reconstruction and expansion of construction projects or facilities irrelevant to the water supply facilities or the protection of drinking water sources;

(ii) establishing ports irrelevant to the needs of water supply;

(iii) carrying out tree planting not for water conservation or bank protection purposes, livestock grazing, or cage aquaculture activities;

(iv) carry out blasting, well drilling, sand mining, animal grazing, tomb constructing, discarding or burying dead bodies of animals;

(v) sailing, parking or operating of vessels, rifts or various homemade tools for purposes other than water supplying, flood prevention or the protection of water sources;

(vi) washing vehicles, clothing or other utensils;

(vii) organizing trips, water training, camping or picnics;

(viii) swimming, fishing or releasing captive animals;

(ix) other activities prohibited by relevant laws and regulations and Article 15 of these Regulations.

Any built-up construction project or facility irrelevant to water supply facilities or the drinking water sources protection shall be ordered by the competent people’s government to dismantle or shut down and carry out restoration of the ecosystem.

 

Article 17 No vehicles transporting hazardous chemicals or hazardous wastes or other toxic or harmful materials may arbitrarily enter the protected areas of drinking water sources. Where it is indeed necessary, approval from the public security organ of the county-level people’s government shall be obtained.

The public security organ of the county-level people’s government shall designate certain areas where the transit of vehicles transporting toxic or harmful materials are restricted, and set up conspicuous signs.

 

Article 18 The professional breeding households or small-scale livestock households in the Grade II drinking water source reserves shall take necessary pollution prevention measures to properly deal with livestock wastes and meet the requirements for leak proof, rainproof and spillover-proof.

 

Article 19 Residents within the Grade I drinking water source reserves shall be relocated. The municipal people’s government shall organize the formulation of the specific relocation plans.

 

Article 20 The people’s governments at all levels shall strengthen the comprehensive administration of rural environment, improve the centralized collection and processing system of household waste water, garbage and fallen stocks, and prevent the pollution of water sources.

 

Article 21 The people’s governments at all levels shall implement the river chief system, establish and complete the mechanism for management and control of river pollution,.

 

Article 22 The agriculture and rural affairs departments of the municipal and district (county-level city) people’s governments shall take effective measures to instruct agricultural producers on the scientific and sensible use of fertilizers and pesticides, promote the use of soil testing formulas, fertilizing technologies and highly effective pesticides with low-toxic and low-residue, control the excessive use of fertilizers and pesticides, and reduce agricultural pollution.

The agricultural producers within the watershed of drinking water sources shall, in accordance with relevant provisions, utilize fertilizers and pesticides in a safe and reasonable manner, adopt new technologies and technologies for the comprehensive prevention and treatment of pests and diseases, and reduce the amount of fertilizers and pesticides used.

Article 23 The district and county-level city people’s governments shall establish a recycling system of pesticide packages, reflective strips or other wastes from farming material products that cause water source pollution in the protected areas of drinking water sources and the specific implementation measures shall be formulated by the district and county-level city people’s governments in light of the local situations.

 

Article 24 The district and county-level city people’s governments shall establish assistant teams for water source protection within the protected areas of drinking water sources, establish routine inspection system and assist the relevant departments in the protection of drinking water sources.

 

Article 25 The forestry departments of the municipal and district (county-level city) people’s governments shall, for the purposes of protecting the ground cover plants, preserving the balance between water and soil, and preventing the silting and clogging of rivers and reservoirs, strengthen the development and management of water conservation forests and bank protection forests in drinking water source reserves and quasi-reserves.

 

Article 26 The farmland within the Grade I protected areas of drinking water sources shall be restored to forest. The municipal and district (county-level city) people’s governments shall formulate plans for restoring farmland to forest and organize the implementation thereof.

 

Article 27 The municipal and district (county-level city) people’s governments shall establish and complete the special compensation mechanisms for the drinking water sources. The municipal people’s government shall organize the formulation of the specific means, scopes, recipients and standards of compensation.

 

Article 28 The municipal and district (county-level city) people’s governments shall coordinate ecological environment department and other relevant departments to conduct regular survey and assessment of the environmental condition and pollution risk of the areas surrounding the drinking water resource reserves and water suppliers, check the possible pollution risk factors and take corresponding measures to prevent the risks.

 

Article 29 The municipal and district (county-level city) ecological environment departments and the hydrologic institutions shall monitor the water quality of drinking water sources in accordance with the law and timely disclose the water quality information to the public.

 

Article 30 The municipal and district (county-level city) people’s governments and the departments of ecological environment and water shall formulate contingency plans for emergency drinking water source pollution incidents, set up reserves for emergency supplies, and improve the warning mechanism and support measures.

The water suppliers shall formulate contingency plans and reserve supplies for emergency drinking water source pollution incidents, establish emergency response offices, register such offices with the competent municipal and district (county-level city) people’s governments and conduct emergency drills on a regular basis.

Units within the protected areas of drinking water sources shall formulate contingency plans for emergency water pollution incidents and conduct emergency drills on a regular basis.

 

Article 31 where any water pollution incident or other emergency incident that may affect the safety of drinking water occurs, the drinking water sources administration organs and water suppliers shall take emergency measures, timely report the incident to the competent municipal or district (county-level city) people’s government and the administrative departments of ecological environment and water, and disclose the information to the public in accordance with the law. Relevant municipal and district (county-level city) people’s governments and the departments of ecological environment and water shall activate contingency plans in light of the actual situations, and take effective measures to ensure the safety of drinking water.

 

Chapter  Legal Responsibilities

Article 32 Where any law or regulation has provided for the legal liabilities for violation of these Regulations, such law or regulation shall prevail.

 

Article 33 Where the municipal or district (county-level city) people’s government, relevant departments or the staff thereof conducts any of the following acts, the supervisor and other personnel directly responsible shall be sanctioned in accordance with laws.:

(i) failing to delimit or adjust the protection reserves of drinking water sources as required by the law;

(ii) failing to make investigation and punishment in a timely manner after noticing illegal activities of damaging or polluting drinking water sources, or after receiving reports on such illegal activities;

(iii) failing to issue administrative licenses or approval documentation as required by the law;

(iv) failing to set up landmarks, warning signs or isolation protection facilities as required by the regulations;

(v) failing to monitor the water quality of drinking water sources as required by the law and disclose the water quality information to the general public in a timely manner;

(vi) failing to formulate contingency plans for emergency drinking water source pollution incidents as required by the law;

(vii) other activities involving abuse of power, neglect of duty and play of favoritism and commission of irregularities.

 

Article 34 Any unit or individual, in violation of Paragraph 2 of Article 13 of these Regulations, deliberately deface or arbitrarily remove any landmark, warning sign, or isolation protection facility shall be ordered by the public security organ to make rectification within a specified time limit, and a fine of no more than RMB 1,000 and no more than RMB 10,000 shall be imposed.

 

Article 35 Any unit or individual, in violation of Articles 14, Article 15 and Article 16 of these Regulations, carrying out new construction, reconstruction and expansion of any construction project with severe water pollution risks shall be ordered by the ecological environment department to dismantle or shut down within a specified time limit upon being approved by the competent people’s government and a fine of no more than RMB 200,000 and no more than RMB 500,000 shall be imposed; in case of carrying out new construction, reconstruction and expansion of any construction project that may pollute the water and had no effective prevention and control measure, be ordered by the ecological environment department to dismantle or shut down within a specified time limit upon being approved by the competent people’s government and a fine of no more than RMB 100,000 and no more than RMB 200,000 shall be imposed

 

Article 36 Any unit or individual, in violation of Articles 14, Article 15 and Article 16 of these Regulations, discarding pesticide packages, reflective strips or other waste from farming material products, or cleaning equipment of pesticide application within the drinking water source quasi-reserves and reserves shall be ordered by the agriculture and rural affairs departments to make rectification within a specified time limit, and a fine of no more than RMB 50,000 and no more than RMB 100,000 shall be imposed on the unit such as the agricultural production enterprises, professional cooperatives of peasants that engage in agricultural production and otherwise; or a fine of no more than RMB 200 and no more than RMB 2,000 on the individual; where any crime is constituted, criminal liabilities shall be investigated in accordance with law.

 

Article 37 Any unit or individual, in violation of Articles 14, Article 15 and Article 16 of these Regulations, using extreme-toxic, high-toxic or high-persistent pesticides within the drinking water source quasi-reserves and reserves shall be ordered by the agriculture and rural affairs departments to make rectification within a specified time limit, and a fine of RMB 100,000 shall be imposed on the unit such as agricultural production enterprises, professional cooperatives of peasants that engage in agricultural production and otherwise; or a fine of RMB 10,000 on the individual; where any crime is constituted, criminal liabilities shall be investigated in accordance with law.

 

Article 38 Any unit or individual, in violation of Article 15 and Article 16 of these Regulations, dumping or landfilling industrial wastes, medical wastes or other toxic and harmful wastes in the drinking water source quasi-reserves and reserves shall be ordered by the ecological environment departments to make rectification within a specified time limit, and a fine of no more than RMB 100,000 and no more than RMB 200,000 shall be imposed, where any crime is constituted, criminal liabilities shall be investigated in accordance with law.

Article 39 Any unit or individual, in violation of Article 15 and Article 16 of these Regulations, carrying out new construction and reconstruction of professional breeding households within the drinking water source quasi-reserves and reserves shall be ordered by the ecological environment departments to dismantle or shut down within a specified time limit and a fine of no more than RMB 20,000 and no more than RMB 100,000 shall be imposed.

 

Article 40 Any professional breeding household or small-scale livestock household within the Grade II drinking water source reserves, in violation of Article 18 of these Regulations, failing to take necessary pollution prevention measures to properly deal with livestock wastes shall be ordered by the ecological environment departments to make rectification within a specified time limit, and a fine of no more than RMB 3,000 and no more than RMB 30,000 shall be imposed on the professional breeding household and a fine of no more than RMB 3,000 on the small-scale livestock household.

 

Article 41 Where any unit or individual, in violation of Articles 14, Article 15 and Article 16 of these Regulations, carries out any illegal act on the water body within the Grade I drinking water source reserves, the administration department may entrust eligible drinking water source regulatory agencies to issue the punishment.

 

Chapter V Supplementary Provisions

Article 42 These Regulations shall come into force as of November 1, 2017.
