   《威海市山体保护条例》已于2020年10月29日经威海市第十七届人民代表大会常务委员会第二十八次会议通过,并于2020年11月27日经山东省第十三届人民代表大会常务委员会第二十四次会议批准,现予公布,自2021年1月1日起施行。

                                           威海市山体保护条例

                  第一章  总  则


    第一条  为了加强山体保护,维护生态安全,推动精致城市建设,促进经济社会可持续发展,根据《中华人民共和国土地管理法》《中华人民共和国城乡规划法》《中华人民共和国森林法》等法律法规,结合本市实际,制定本条例。

第二条  本市行政区域内山体的保护、修复、利用、管理以及其他相关活动,适用本条例。

第三条  山体保护应当坚持生态优先、科学规划、防治结合、合理利用的原则。

第四条  市、区(县级市)人民政府应当加强对山体保护工作的组织领导,将山体保护工作纳入国民经济和社会发展规划,建立健全山体保护工作协调机制,保障经费投入。

第五条  自然资源行政主管部门负责山体保护的监督管理工作。

发展改革、公安、民政、生态环境、住房城乡建设、规划、水务、农业农村、文化和旅游、应急管理、林业等行政主管部门按照各自职责,做好山体保护的相关工作。

第六条  任何单位和个人有权举报和制止破坏山体的行为。举报受理部门应当依法处理。

第七条  市、区(县级市)人民政府对在山体保护工作中做出突出贡献的单位和个人,应当按照国家有关规定给予表彰、奖励。

第八条  市、区(县级市)人民政府应当组织开展山体保护宣传教育活动,增强公众山体保护意识。

报刊、广播电视、网络等公共媒体应当加强对山体保护的公益宣传。

 

第二章  保护规划

 

第九条  市人民政府应当组织有关部门编制山体保护专项规划。山体保护专项规划是山体保护工作的基本依据,山体的保护、修复、利用、管理等活动应当符合山体保护专项规划的要求。

山体保护专项规划应当符合国土空间总体规划,并与其他专项规划相衔接。

第十条  山体保护专项规划应当包括下列内容:保护名录、保护区域、保护级别、法定图则、管控措施以及其他有关事项。

第十一条  符合下列条件之一的山体,应当纳入保护名录:

(一)反映城乡自然山水格局主要特征的;

(二)承载地域历史文化记忆的;

(三)具有生态保护和修复、防洪排涝、水源涵养等功能的;

(四)具有特殊经济、文化、社会、生态和军事价值的;

(五)其他应当纳入保护名录的。

第十二条  对纳入保护名录的山体,应当划定保护区域。保护区域的保护级别分为重点保护区和一般保护区。

符合下列条件之一的,划入重点保护区:

(一)自然形态完整、景观原生独特的;

(二)具有历史文化保护和军事价值的;

(三)对生态、景观或者居民生活具有重要影响的;

(四)地质灾害易发、水土流失严重以及生态脆弱的;

(五)其他应当重点保护的区域。

重点保护区以外的保护区域为一般保护区。

第十三条  编制山体保护专项规划,应当广泛听取社会各方面的意见和建议。山体保护专项规划向社会公开征求意见的时间不少于三十日。

第十四条  山体保护专项规划应当经市人民政府研究同意,报经市人民代表大会常务委员会审议通过后,向社会公布。

第十五条  除因国土空间总体规划调整和国家、省、市重大公益性项目建设需要外,山体保护专项规划不得修改。

山体保护专项规划的修改应当由原编制机关提出方案,按照本条例第十三条、第十四条规定的程序办理。

 

第三章  保护措施

 

第十六条  市、区(县级市)人民政府应当根据山体保护专项规划的要求,完善保护机制,明确保护责任,落实保护措施,增强山体的生态功能。

第十七条  区(县级市)人民政府应当设立山体保护界桩或者标志牌,标明保护区域、保护级别以及责任单位等内容。

任何单位和个人不得擅自设立、移动、涂改或者损毁山体保护界桩或者标志牌。

第十八条  市、区(县级市)人民政府应当组织相关部门制定森林火灾、林业有害生物、地质灾害的防治措施和应急预案。

第十九条  山体保护实行责任主体制度。属国家所有的,其管理者为责任主体;属集体所有的,该集体组织为责任主体。

山体保护责任主体应当建立健全保护制度,加强日常巡查,及时制止并向有关行政主管部门报告破坏山体的行为。

第二十条  在重点保护区内,除防范森林火灾、地质灾害等防灾减灾建设项目,符合规划的山体景观游赏设施建设项目和国防、军事等特殊用途建设项目外,禁止一切损毁山体、破坏生态环境和生态平衡的行为。

禁止新设探矿权、采矿权,本条例施行前依法设立的探矿权、采矿权期限届满的,不再续期。

第二十一条  在一般保护区内,禁止实施下列行为:

(一)擅自探矿采矿;

(二)擅自开山采石、挖砂、取土;

(三)擅自新建、改建、扩建建(构)筑物;

(四)毁林开荒、乱砍滥伐林木;

(五)非法采挖重点保护野生植物,非法狩猎;

(六)倾倒、堆放生活垃圾或者建筑垃圾和其他废弃物;

(七)其他破坏山体的行为。

第二十二条  风景名胜区、自然保护区、森林公园、地质公园、饮用水水源保护区、海岸带等区域内的山体纳入山体保护区域的,其他法律法规作出更为严格保护规定的,适用其他法律法规的规定。

第二十三条  山体的开发利用应当坚持合法、有序、环保、适度的原则,合理确定开发区域边界,提高开发利用效率,最大限度节约资源。

开发利用山体应当坚持“谁开采、谁治理,谁受益、谁复绿”,做到开发利用与治理同步进行,将对山体的损害控制到最低限度。

第二十四条  破损山体应当及时修复治理,恢复自然景观和生态功能。

造成山体破损的单位和个人应当承担修复治理责任。

因自然因素破坏或者造成山体破损的责任主体灭失以及无法确定责任主体的,破损山体的修复治理由所在区(县级市)人民政府负责。

鼓励社会资本参与山体修复治理。

第二十五条  负有山体修复治理责任的单位和个人应当会同山体保护责任主体,依据山体保护专项规划和相关设计规范、技术标准编制山体修复治理方案,经专家论证后,报自然资源行政主管部门备案并组织实施。

第二十六条  山体修复治理不得对周边区域的生态环境造成再破坏。

第二十七条  山体修复治理工程竣工后,负有山体修复治理责任的单位和个人应当会同山体保护责任主体,依照法律法规和山体修复治理方案组织竣工验收,并将验收合格的有关资料报自然资源等行政主管部门备案。

 

第四章  法律责任

 

第二十八条  违反本条例规定的行为,法律、法规已经规定法律责任的,从其规定。

第二十九条  行政机关及其工作人员有下列行为之一的,对直接负责的主管人员和其他直接责任人员给予处分;构成犯罪的,依法追究刑事责任:

(一)未按照法定程序编制山体保护专项规划的;

(二)违法批准在山体保护区域内建设的;

(三)不依法查处山体保护区域内违法行为的;

(四)不依法履行山体修复治理职责的;

(五)其他滥用职权、玩忽职守、徇私舞弊行为导致山体破坏的。

第三十条  违反本条例第十七条第二款规定,擅自设立、移动、涂改或者损毁山体保护界桩或者标志牌的,由自然资源行政主管部门责令限期改正;逾期不改正的,处一千元以上五千元以下罚款。

第三十一条  违反本条例第十九条第二款规定,山体保护责任主体不制止或者报告破坏山体行为的,由自然资源行政主管部门处二千元以上一万元以下罚款。

第三十二条  违反本条例规定,未履行修复治理责任的,由自然资源行政主管部门责令限期修复治理;逾期不履行,经催告仍不履行的,自然资源行政主管部门可以代为修复治理,或者委托没有利害关系的第三方代为修复治理,所需费用由山体修复治理责任人承担,并可以处所需费用一倍以下罚款。

 

第五章   

 

    第三十三条  本条例自2021年1月1日起施行。

The Regulations of Weihai Municipality on Mountain Protection, as adopted at the 28th session of the Standing Committee of the 17th People’s Congress of Weihai Municipality on October 29, 2020 and approved at the 24th session of the Standing Committee of the 13th People’s Congress of Shandong Province on November 27, 2020, is hereby promulgated and shall come into force as of January 1, 2021.

Regulations of Weihai Municipality on Mountain Protection

(Adopted at the 28th session of the Standing Committee of the 17th People’s Congress of Weihai Municipality on October 29, 2020 and approved at the 24th session of the Standing Committee of the 13th People’s Congress of Shandong Province on November 27, 2020.)

 

Chapter I General Provisions

Article 1 These Regulations are enacted in accordance with the Land Administration of the People’s Republic of China, Urban and Rural Planning Law of the People’s Republic of China, Forestry Law of the people’s Republic of China and other laws and regulations and in light of the actual situations of this Municipality, for the purposes of strengthening mountain protection, maintaining ecological security, promoting delicate city construction and facilitating sustainable economic and social development.

 

Article 2 These Regulations shall be applicable to the protection, restoration, utilization, and administration of mountain, and other related activities within the administrative areas of this Municipality.

 

Article 3 Mountain protection work shall follow the principles of ecology first, scientific planning, combination of prevention and treatment, and rational utilization.

 

Article 4 The municipal and district (county-level city) people’s governments shall strengthen the organization and leadership in mountain protection, incorporate the mountain protection work into the national economic and social development planning, establish and complete mountain protection work coordination mechanism, and guarantee fund investment.

 

Article 5 The natural resources department shall take charge in the supervision and management of mountain protection.

The departments of development and reform, public security, civil administration, ecologic environment, housing and urban-rural construction, planning, water-related affairs, agriculture and rural areas, culture and tourism, emergency management, forestry and otherwise shall, in accordance with their respective functions and duties, make solid implementation of mountain protection-related work.

 

Article 6 All units and individuals shall be entitled to report and prevent any act that may damage the mountain. Department accepting the report shall handle such report in accordance with laws.

 

Article 7 The municipal and district (county-level city) people’s governments shall, in accordance with relevant national regulations, grant commendation and reward to units and individuals making outstanding contributions to mountain protection.

 

Article 8 The municipal and district (county-level city) people’s government shall organize and carry out mountain protection publicity and education activities and increase public awareness of mountain protection.

Newspapers, broadcast television, network and other public media shall strengthen the public welfare promotion of mountain protection.

 

Chapter II Protection Planning

Article 9 The municipal people’s government shall organize relevant departments to formulate special mountain protection planning. The special mountain protection planning shall be the fundamental basis of mountain protection work. The protection, restoration, utilization, and management of mountain protection and other activities related shall comply with the requirements of the special mountain protection planning.

The special mountain protection planning shall comply with the overall national spatial planning and cohere with other special planning.

 

Article 10 The special mountain protection planning shall include the following contents: protection catalogue, protected area, protection level, statutory plan, control measures, and other relevant affairs.

 

Article 11 A mountain shall be included in the protection catalogue if it:

(i) reflects the main features of urban and rural natural landscape pattern;

(ii) bears the regional historical and cultural memory;

(iii) has such functions as ecology protection and restoration, flood control and drainage, water conservation and otherwise;

(iv) has special economic, cultural, social, ecological and military significance; or

(v) has any other circumstance qualifying for inclusion in the protection catalogue.

 

Article 12 Protected areas shall be delineated for each mountain listed in the protection catalogue. Protected areas shall, in accordance with the protection level, be divided into key protected areas and general protected areas.

A protected area shall be included into key protected areas if it:

(i) has integrated natural features and native and unique landscape;

(ii) has the historical and cultural protection value and military value;

(iii) has significant impact on ecology, landscape or the lives of residents;

(iv) is prone to geological disasters, or has serious soil erosion or is ecologically fragile; or

(v) is the area that shall be under key protection.

All protected areas other than key protected areas shall be listed as general protected areas.

 

Article 13 When formulating special mountain protection planning, opinions and suggestions from all sectors of society shall be solicited and considered. Public opinions on special mountain protection planning shall be solicited for no less than 30 days.

 

Article 14 The special mountain protection planning shall, upon being considered and approved by the municipal people’s government, be submitted to the Standing Committee of the Municipal People’s Congress for deliberation, and shall be released to the social public upon approval.

 

Article 15 The special mountain protection planning shall not be amended unless it is required due to adjustment of the overall national spatial planning or the construction of any national, provincial, or municipal major public welfare project.

When amending the special mountain protection planning, the original formulation organ shall put forward a proposal and the amendment shall be handled in accordance with Article 13 and Article 14 herein.

 

Chapter III Protective Measures

Article 16 The municipal and district (county-level city) people’s governments shall, in accordance with the requirements of the special mountain protection planning, improve the protection mechanism, specify protection responsibilities, implement protective measures, and enhance the ecological functions of mountains.

 

Article 17 The district (county-level city) people’s governments shall set up mountain protection boundary posts or signboards to specify the protected areas, protection level, responsible unit and other contents.

No unit or individual may arbitrarily set up, move, obliterate or destroy any mountain protection boundary post or signboard.

 

Article 18 The municipal and district (county-level city) people’s governments shall organize relevant departments to formulate the preventive measures and contingency plan of forest fire, forest pest, and geological disasters.

 

Article 19 Responsible body system shall be applied in mountain protection. Where a mountain is owned by the state, the administrator thereof shall be the responsible body; where a mountain is owned collectively, the collective organization shall be the responsible body.

The subjects liable for mountain protection shall establish and complete the protection system, strengthen routine inspection, and promptly stop acts damaging the mountain and report such to relevant administrative departments.

 

Article 20 Any act that may damage mountain, destroy ecological environment, or ecological balance shall be prohibited in key protected areas unless it is required by such disaster prevention and mitigation construction projects as forest fire prevention, geological disasters and otherwise, or complies with planned mountain landscape tour facility construction projects, or construction projects of special purposes such as national defense and military.

No new exploration right or mining right may be created. Where the exploration right or mining right created before these Regulations coming into force expires, such right shall not be renewed.

 

Article 21 None of the following acts may be conducted in the general protected areas:

(i) arbitrarily exploring or mining materials;

(ii) arbitrarily cutting into a mountain for quarrying, coping down or collecting earth;

(iii) arbitrarily carrying out new construction, reconstruction or extension of buildings or structures;

(iv) destroying forests for farming and conducting excessive deforestation;

(v) carrying out illegal collection of key-protected wild plants and illegal hunting activities;

(vi) dumping and stacking household wastes, construction wastes and other wastes;

(vii) other acts that may destroy the mountain.

 

Article 22 Where any mountain within any tourist attraction, natural reserve, forest park, geopark, drinking water source protected area, coastal zone and otherwise is included in the protected areas of mountain and other laws and regulations have provided for stricter protection, such laws and regulations shall prevail.

 

Article 23 The development and utilization of mountain shall follow the principles of legitimacy, orderliness, environmental protection, and appropriateness, determine the boundaries of development area in a rational manner, increase the efficiency of development and utilization, and save resources to the maximum.

The development and utilization of mountain shall stick to the principle of “whoever exploits shall be responsible for governance and whoever benefits shall be responsible for the restoration”, carry out development and utilization and governance simultaneously, and control the damage to mountain to the minimum degree.

 

Article 24 The damaged mountain shall be restored in a timely manner to recover the natural landscape and ecological functions.

The unit and individual causing damage to the mountain shall bear the responsibility of restoration.

Where the subject liable for damage or destruction of mountain due to natural factors is lost or cannot be identified, the district (county-level city) people’s government where the mountain locates shall be responsible for the restoration of damaged mountain.

Social capital shall be encouraged to participate in restoration of mountain.

 

Article 25 The units and individuals responsible for restoration of mountain shall, in collaboration with the subjects liable for mountain protection, formulate the mountain restoration plan in accordance with the special mountain protection planning and relevant design specifications and technical standards, arrange discussion by experts, submit to the natural resources department for recordation and organize implementation thereof.

 

Article 26 The restoration of mountain shall not cause secondary destruction to the ecological environment of the surrounding areas.

 

Article 27 The units and individuals responsible for restoration of mountain shall, upon completion of mountain restoration project and in collaboration with the subject liable for mountain protection, organize the completion acceptance in accordance with laws and regulations and the mountain restoration plan and submit relevant materials of completion acceptance to the natural resources department and otherwise for recordation.

 

Chapter IV Legal Liabilities

Article 28 Where laws and regulations have provided for the legal liabilities of violation of these Regulations, such laws and regulations shall prevail.

 

Article 29 Where any administrative organ or staff thereof conducts any of the following acts, the executive and other persons directly responsible shall be sanctioned; where any crime is constituted, criminal liability shall be investigated in accordance with laws:

(i) failing to formulate the special mountain protection planning in accordance with the statutory procedures;

(ii) illegally approving any construction within the protected areas of mountain;

(iii) failing to investigate illegal acts within the protected areas of mountain;

(iv) failing to perform the functions and duties of mountain restoration;

(v) other conducts involving abuse of power, neglect of duty and play of favoritism and commission of irregularities that have caused damage to the mountain.

 

Article 30 Any unit or individual, in violation of Paragraph 2 of Article 17 of these Regulations, arbitrarily establish, move, obliterate, or destroy the mountain protection boundary posts or signboards shall be ordered by the natural resources department to make rectification within specified time limit; failing which a fine of no less than RMB 1,000 and no more than RMB 5,000 shall be imposed.

 

Article 31 Any subject liable for mountain protection, in violation of Paragraph 2 of Article 19 of these Regulations, failing to promptly stop or report acts that damage mountain shall be imposed a fine of no less than RMB 2,000 and no more than RMB 10,000 by the natural resources department.

 

Article 32 Any unit or individual, in violation of these Regulations, failing to perform the responsibilities of restoration shall be ordered by the natural resources department to implement restoration within specified time limit; where the unit or individual fails to implement restoration within specified time limit and refuses to implement upon interpellation, the natural resources department may carry out restoration on behalf thereof, or entrust an uninterested third party make restoration. The corresponding fees shall be borne by the subjects liable for mountain restoration and a fine of no more than the restoration fees may be imposed.

 

Chapter V Supplementary Provision

Article 33 These Regulations shall come into force as of January 1, 2021.
