威海市海洋牧场管理条例

第一章  总  则


  第一条  为了规范海洋牧场管理,加强海洋生态环境保护,推动海洋经济高质量发展,根据有关法律、法规,结合本市实际,制定本条例。

  第二条  本条例适用于本市管辖海域内海洋牧场的规划建设、生产经营、平台管理和所涉海域生态保护的监督管理等相关活动。

  第三条  海洋牧场的发展应当遵循科学规划、生态优先、合理利用和安全有序的原则。

  第四条  市、区(县级市)人民政府应当加强对海洋牧场发展的组织领导,将海洋牧场建设纳入本地区国民经济和社会发展规划,建立海洋牧场管理综合协调机制,解决海洋牧场发展中的重大问题。

  第五条  渔业行政主管部门负责海洋牧场的综合协调和管理工作。

  发展改革、科技、工业和信息化、公安、财政、自然资源、生态环境、交通运输、文化旅游、应急管理、行政审批、市场监督管理、海事、气象等部门、单位,按照各自职责,共同做好海洋牧场管理工作。

  沿海镇人民政府、街道办事处应当依照职责做好海洋牧场监督管理工作。

  第六条  本市与胶东经济圈其他四个设区的市协同推进下列海洋牧场管理工作:

  (一)编制海洋牧场规划时相互衔接;

  (二)建立海洋牧场管理信息沟通和重大事件通报制度,实现海洋牧场管理信息共享;

  (三)建立执法联动响应和协作机制;

  (四)其他协商确定的合作事项。

  第七条  本市会同胶东经济圈其他四个设区的市加强海洋牧场及相关产业基础研究、技术创新,引进和培养高层次科研团队和人才,合力打造高能级海洋牧场科技创新平台,联合推动海洋牧场科技成果转化,全面提升海洋牧场及相关产业创新能力。


第二章  海洋牧场的规划建设


  第八条  市渔业行政主管部门应当会同有关部门编制全市海洋牧场规划,报请市人民政府批准后组织实施。

  编制海洋牧场规划应当符合国土空间规划,遵循陆海统筹、科学布局、优化结构、完善功能的原则,并与海上交通、环境保护、海岸带保护、海岛保护、港口、旅游等规划相衔接。

  对海洋牧场规划中的位置、面积、布局、功能等内容作出重大调整的,应当重新报批。

  第九条  开发建设海洋牧场项目应当依法取得海域使用权和海洋环境影响评价等文件。

  第十条  海洋牧场建设应当符合相关技术规范要求,建设材料应当符合生态环境保护要求。

  第十一条  市、区(县级市)人民政府及相关单位应当加强海洋牧场管理的科学研究和先进技术的推广应用,充分利用现代科学技术成果,提升海洋牧场管理的能力和水平。

  鼓励和支持运用人工智能、大数据、云计算、物联网、卫星遥感等先进技术手段,打造智慧型海洋牧场,推动海洋牧场信息化、自动化、智能化发展。

  第十二条  市、区(县级市)人民政府应当建立多元化投入机制,在项目和资金安排上对海洋牧场建设给予支持。

  鼓励生态补偿资金、金融资本以及其他社会资本参与海洋牧场建设和经营,推动海洋牧场规模化发展。

  第十三条  海洋牧场岸基配套设施建设应当与海岸带综合整治、渔业码头升级改造相衔接。


第三章  海洋牧场的生产经营


  第十四条  在海洋牧场海域内从事生产经营活动时,应当防止环境污染,保护生态环境,并遵守下列规定:

  (一)从事养殖的,应当科学确定养殖模式、种类和密度,使用的药物、肥料、饵料应当符合技术规范;

  (二)从事捕捞的,应当遵守渔具准入等管理规定;

  (三)从事垂钓等休闲活动的,其活动方式应当符合法律规定;

  (四)法律、法规规定的其他要求。

  第十五条  市、区(县级市)人民政府应当鼓励通过建设人工鱼礁和实施增殖放流等措施,养护近岸渔业资源,保护和修复海洋生态环境,推动海洋牧场绿色发展。

  建设人工鱼礁,应当符合环境保护要求,有利于维护海底生态环境平衡。

  实施增殖放流活动,应当符合水生生物增殖放流规定,加强放流苗种的检验检疫,防止外来有害物种入侵。

  第十六条  鼓励和支持海洋牧场配备水下在线监测系统,实时监测海洋牧场环境和渔业资源变化情况。

  第十七条  海洋牧场所有人或者经营人应当对海洋牧场的生产经营和平台运营的安全承担主体责任,并遵守下列规定:

  (一)遵守安全生产、环境保护等法律、法规,建立健全安全生产管理制度,完善安全生产防护措施;

  (二)配备适合的海陆通讯设备,保持通讯畅通;

  (三)制定应急救援预案,并定期组织演练;

  (四)法律、法规规定的其他要求。

  海洋牧场内发生事故或者险情,其所有人或者经营人应当按照应急救援预案的要求,采取应急救援措施,并及时向渔业行政主管部门、海上搜救机构报告。

  第十八条  海洋牧场的开发、建设和经营,不得影响船舶正常航行安全和其他公共设施安全。


第四章  海洋牧场平台的管理


  第十九条  海洋牧场平台应当经法定的船舶检验机构检验合格,取得检验合格证书、文书。未取得检验合格证书、文书的海洋牧场平台不得投入使用。

  海洋牧场平台应当按照设计的用途使用,依法定期进行安全技术检验。

  投入使用的海洋牧场平台达到报废标准的,其所有人或者经营人应当依法拆除。

  第二十条  海洋牧场平台所有人或者经营人应当遵守下列规定:

  (一)配备符合标准的船舶自动识别终端,正确显示号灯、号型,并保持正常运行;

  (二)配备能够熟练掌握救生、消防、通信、避碰等专业技能的人员,且符合最低安全配员要求;

  (三)配备与其规模相适应的救生、消防、通信、定位、视频监控以及防漏电、防雷击等安全设施,且保持完好状态;

  (四)建立日常维护保养、安全生产培训等制度,制定岗位安全操作规程,完善安全营运档案 ,定期排查安全隐患;

  (五)配备垃圾分类回收设备设施,及时清理打捞平台周边垃圾;

  (六)法律、法规规定的其他要求。

  第二十一条  利用海洋牧场平台从事观光、垂钓、餐饮、娱乐、文化、科普等活动,除遵守本条例第二十条规定外,还应当遵守下列规定:

  (一) 保持人员值守瞭望;

  (二) 在显著位置悬挂或者张贴安全须知、设置警示标牌;

  (三) 建立临时登乘人员登离台账,实际承载人数不得超过核载人数;

  (四)法律、法规规定的其他要求。

  第二十二条  当实时海况达到下列条件之一的,禁止临时登乘人员登乘海洋牧场平台;已登临海洋牧场平台的,应当在确保安全的前提下撤离:

  (一)风力达到蒲氏风级五级以上的;

  (二)能见度低于一千米的;

  (三)浪涌达到大浪级别的。

  当气象、海洋部门发布的海上风浪预报等级超过海洋牧场平台设计的抗风浪等级时,所有人员全部撤离。

  法律、法规另有规定和安全生产另有要求的,从其规定。

  第二十三条  在海洋牧场平台使用明火应当符合用火规范要求。

  第二十四条  海洋牧场平台临时登乘人员应当遵守下列规定:

  (一)遵守管理制度和操作规程,服从平台管理人员管理,接受必要的安全检查;

  (二)穿着符合标准的救生衣;

  (三)不得携带易燃、易爆等危险物品;

  (四)不得从事危及他人和自身安全的危险活动;

  (五)不得向海洋中抛投垃圾;

  (六)法律、法规规定的其他要求。


第五章  法律责任


  第二十五条  对违反本条例规定的行为,法律、法规对其法律责任已经作出规定的,从其规定。

  第二十六条  海洋牧场管理有关部门及其工作人员玩忽职守、滥用职权、徇私舞弊的,对直接负责的主管人员和其他直接责任人员依法给予处分;构成犯罪的,依法追究刑事责任。

  第二十七条  违反本条例第二十条第一项规定,海洋牧场平台未配备并开启符合标准的船舶自动识别终端,或者未按照规定正确显示号灯、号型的,由渔业行政主管部门责令改正;拒不改正的,对其所有人或者经营人处二万元以上五万元以下罚款。

  第二十八条  违反本条例第二十一条第一项、第三项规定,未保持人员值守瞭望,或者未建立临时登乘人员登离台账的,由渔业行政主管部门责令改正;拒不改正的,对其所有人或者经营人处五千元以上一万元以下罚款。

  第二十九条  违反本条例第二十二条规定的,由渔业行政主管部门责令改正,对其所有人或者经营人处二万元以上五万元以下罚款;情节严重的,处五万元以上十万元以下罚款,并责令停产停业整顿。

  第三十条  海洋牧场平台临时登乘人员违反本条例第二十四条第一项、第二项规定的,海洋牧场平台所有人或者经营人应当进行劝阻;经劝阻后仍不改正的,应当告知渔业行政主管部门予以处理。渔业行政主管部门应当对违法的临时登乘人员进行批评教育,责令改正违法行为,予以警告,并处二百元以上五百元以下罚款。


第六章  附  则


  第三十一条  本条例中下列用语的含义:

  (一)海洋牧场,是指基于海洋生态系统原理,在特定海域,通过建设人工鱼礁、增殖放流、立体养殖等措施,构建或者修复海洋生物繁殖、生长、索饵或者避敌所需的场所,增殖养护渔业资源,改善海域生态环境,实现渔业资源可持续利用的渔业模式。

  (二)海洋牧场平台,是指在海洋牧场海域内设置的用于开展海洋牧场环境监测、渔业生产、海上看护、牧渔体验、生态观光、安全救助等活动的设施。

  (三)人工鱼礁,是指为修复和优化海洋生态环境,保护和增殖渔业资源,有目的地在自然海域中设置的人工构筑物。

  (四)临时登乘人员,是指临时登上海洋牧场平台从事牧渔体验、生态观光等活动的人员。

  第三十二条  本条例自2022年5月1日起施行。


Regulations of Weihai Municipality on Marine Ranching Management

Chapter I General Provisions

Article 1 These Regulations are enacted in accordance with relevant laws and regulations and in light of actual situations of this Municipality, for the purposes of regulating marine ranching management, enhancing protection of marine ecological environment, and promoting high-quality development of marine economy.

Article 2 These Regulations shall be applicable to the planning, construction, production, operation, and platform management of marine ranching, the supervision and management of ecological protection of related sea areas and other relevant activities within the marine jurisdiction of this Municipality.

Article 3 The development of marine ranching shall comply with the principles of scientific planning, ecology first, reasonable utilization, safety and order.

Article 4 The municipal and district (county-level city) people’s governments shall enhance the organization and leadership in the marine ranching development, integrate the construction of marine ranching in their respective national economic and social development planning, establish the comprehensive coordination mechanism for marine ranching management, and resolve major issues in the marine ranching development.

Article 5 The fishery department shall be responsible for the comprehensive coordination and management of marine ranching.

The departments and units of development and reform, science and technology, industry and information, public security, finance, natural resources, ecological environment, transportation, cultural tourism, emergency management, administrative approval, market supervision and management, maritime, meteorology, and otherwise shall, in accordance with their respective functions and duties, jointly make solid implementation of marine ranching management.

The people’s governments and sub-district offices of coastal towns shall, in accordance with their respective functions and duties, make solid implementation of marine ranching supervision and management.

Article 6 The Municipality shall, in collaboration with the other four districted cities within the Jiaodong Economic Circle, promote the following marine ranching management:

(i) coordinating with each other in the formulation of marine ranching planning;

(ii) establishing the information communication and major event reporting system of and realizing information sharing of marine ranching management ;

(iii) establishing joint law enforcement response and coordination mechanism;

(iv) other cooperation determined through negotiation.

Article 7 The municipality shall, in collaboration with the other four districted cities within the Jiaodong Economic Circle, enhance the fundamental research and technological innovation of marine ranching and relevant industries, introduce and cultivate high-level scientific research teams and talents, establish high-level marine ranching scientific and technological innovation platform, jointly promote the commercialization of marine ranching scientific and technological achievement, and comprehensively improve the innovation ability of marine ranching and relevant industries.

Chapter II Planning and Construction of Marine Ranching

Article 8 The municipal fishery department shall, in collaboration with relevant departments, formulate the municipal marine ranching planning, submit to the municipal people’s government for approval and organize the implementation thereof upon being approved thereby.

The formulation of marine ranching planning shall conform to the territorial spatial planning, comply with the principles of overall planning for the land and maritime development, scientific layout, optimized structure, and complete functions, and coordinate with planning of marine traffic, environmental protection, coastal belt protection, island protection, harbor, tourism and otherwise.

Any major adjustment to the location, area, layout, function or other content in the marine ranching planning shall be submitted for approval.

Article 9 The development and construction of marine ranching projects shall obtain the use right of sea areas concerned, marine environmental impact assessment document and other documents in accordance with laws.

Article 10 The construction of marine ranching shall comply with the relevant technical specification and the construction materials shall comply with the requirements for ecological environmental protection.

Article 11 The municipal and district (county-level city) people’s governments and relevant units shall enhance the scientific research and advanced technologies promotion and application of marine ranching management, take full advantage of modern scientific and technological achievements, and improve the capacity and level of marine ranching management.

It is encouraged and supported to use artificial intelligence, big data, cloud computing, Internet of Things, satellite remote sensing and other advanced technological means to build intelligent marine ranching and promote the informational, automatic and intelligent development of marine ranching.

Article 12 The municipal and district (county-level city) people’s governments shall establish diversified investment mechanism and give support to the marine ranching construction in terms of project and funding arrangement.

The eco-compensation, financial capital and other social capital shall be encouraged to participate in the construction and operation of marine ranching to promote the scale development of marine ranching.

Article 13 The construction of shore-based supporting infrastructures shall be coordinated with the comprehensive improvement of coastal belt and upgrading and reconstruction of fishery ports.

Chapter III Production and Operation of Marine Ranching

Article 14 Any production and operation activity carried out within the sea areas of marine ranching shall prevent the environmental pollution, protect the ecological environment, and comply with the following provisions:

(i) in case of engaging in aquaculture, scientifically determining the cultivation mode, type and density with the drugs, fertilizers, and baits so used complying with relevant technical specification;

(ii) in case of engaging in fishing, complying with fishing gear admittance regulations and other management regulations;

(iii) in case of engaging in angling and other recreational activities, complying with relevant laws concerning the activity mode;

(iv) other requirements specified by laws and regulations.

Article 15 The municipal and district (county-level city) people’s governments shall encourage the implementation of such measures as establishing artificial fish reef, implementing reproduction and releasing and otherwise to realize the maintenance of offshore fishery resources, protection and restoration of marine ecological environment, and promotion of green marine ranching development.

The establishment of artificial fish reef shall comply with the requirements for environmental protection and be conductive to the maintenance of benthic ecological balance.

The implementation of reproduction and releasing shall comply with the regulations of aquatic organism reproduction and releasing, enhance the inspection and quarantine for the offspring so released, and prevent the invasion of harmful alien species.

Article 16 It is encouraged and supported to equip the marine ranching with underwater online monitoring system to carry out real-time monitoring on the change of environment and fishery resources of marine ranching.

Article 17 The owner or operator of marine ranching shall assume principal responsibility for the safety of production, management, and platform operation of marine ranching and shall comply with the following regulations:

(i) complying with relevant laws and regulations concerning safe production, environmental protection and otherwise, establishing and completing the safe production management system, and optimizing safe production safeguard measures;

(ii) equipping with appropriated sea-land communication devices to keep the communication unobstructed;

(iii) formulating emergency rescue plan and organizing drill thereof at fixed period;

(iv) other requirements specified by laws and regulations.

Where any accident or emergency occurs within the marine ranching, the owner or operator thereof shall, as required by the emergency rescue plan, take emergency rescue measures and report to the fishery department and maritime search and rescue agencies in a timely manner.

Article 18 The development, construction and operation of marine ranching shall not influence the normal navigation safety of vessels or the safety of other public facilities.

Chapter IV Management of Marine Ranching Platform

Article 19 The marine ranching platform shall be inspected by the statutory vessel inspection agency and obtain the inspection certificate and documents, failing which the platform shall not be put into service.

The marine ranching platform shall be used as designed and the safety technical inspection shall be carried thereon at fixed period in accordance with laws.

Where the marine ranching in service reaches the scrapping standards, the owner or operator shall carry out demolition thereof in accordance with laws.

Article 20 The owner or operator of marine ranching platform shall comply with the following provisions:

(i) equipping with qualified automatic ship identification terminal, displaying the line lamp and type in a correct manner, and keeping the normal operation thereof;

(ii) equipping with personnel mastering such professional skills as life-saving, fire protection, communication, collision prevention and otherwise and complying with the minimum requirements for safe manning;

(iii) equipping with appropriate security facilities of life-saving, fire protection, communication, positioning, video surveillance, anti-creeping, lightning protection and otherwise and keep such facilities in good condition;

(iv) establishing systems of daily maintenance, safe production training and otherwise, formulating post safety operation rules, completing safe operation archives, and checking security risks at fixed period;

(v) equipping with equipment and facilities for classified waste recovery and clearing away the wastes surrounding the platform;

(vi) other requirements specified by the laws and regulations.

Article 21 Any owner or operator using the marine ranching platform to engage in sightseeing, angling, catering services, entertainment, cultural activities, popularization of science and other activities shall, in addition to observing Article 20 of these Regulations, comply with the following provisions:

(i) arranging corresponding personnel for lookout;

(ii) hanging or posting safety instruction and establishing warning signs at conspicuous location;

(iii) establishing departure ledger for temporary personnel with the number of actual personnel getting on the platform not exceeding the approved number;

(iv) other requirements specified by laws and regulations.

Article 22 Where the sea condition reaches any of the following conditions, the temporary personnel shall be prohibited from getting on the marine ranching platform; any temporary personnel already on the marine ranching platform shall be evacuated under the premise of ensuring their safety:

(i) where the wind reaches Level 5 of Beaufort Wind Scale;

(ii) where the visibility is below 1,000 meters;

(iii) where the surge reaches the Rough level.

Where the marine storm forecast released by the meteorological and marine departments exceeds the designed storm resistance rating of the marine ranching platform, all personnel shall be evacuated.

Where the laws and regulations provides otherwise and the safe production requires otherwise, such laws, regulations and requirements shall prevail.

Article 23 The use of open fire on the marine ranching platform shall comply with the fire use specification.

Article 24 The temporary personnel getting on the marine ranching platform shall comply with the following provisions:

(i) complying with the management system and operation specifications, obeying the management of platform management personnel, and accept necessary security check;

(ii) wearing qualified life vest;

(iii) not carrying any inflammable and explosive article or any other dangerous article;

(iv) not engaging in any dangerous act endangering the safety of others or themselves;

(v) not throwing any wastes to the sea;

(vi) other requirements specified by laws and regulations.

Chapter V Legal Liabilities

Article 25 Where the laws and regulations have provided for the legal liabilities for violation of these Regulations, such laws and regulations shall prevail.

Article 26 Where the relevant departments of marine ranching management and the staff thereof carry out neglect of duty, abuse of power, play of favoritism and commission of irregularities, the supervisor and other personnel directly responsible shall be given sanctions in accordance with laws; where any crime is constituted, criminal liabilities shall be investigated in accordance with laws.

Article 27 Any marine ranching platform, in violation of Paragraph 1 of Article 20 of these Regulations, failing to equip with and initiate the qualified automatic ship identification terminal or failing to display the line lamp and type in a correct manner as required shall be ordered by the fishery department to make rectification, failing which the owner or operator shall be imposed a fine of no less than RMB 20,000 and no more than RMB 50,000.

Article 28 Any owner or operator, in violation of Paragraph 2 and Paragraph 3 of Article 20 of these Regulations, failing to arrange corresponding personnel for lookout or failing to establish departure ledger for temporary personnel shall be ordered by the fishery department to make rectification, failing which the owner or operator shall be imposed a fine of no less than RMB 5,000 and no more than RMB 10,000.

Article 29 Any marine ranching platform violating Article 22 of these Regulations shall be ordered by the fishery department to make rectification with the owner or operator being imposed a fine of no less than RMB 20,000 and no more than RMB 50,000; where any serious consequence is caused, be imposed a fine of no less than RMB 50,000 and no more than RMB 10,000 and be ordered to suspend production for rectification.

Article 30 Any temporary personnel getting on the marine ranching platform, in violation of Paragraph 1 and Paragraph 2 of Article 24 of these Regulations shall be dissuaded by the owner or operator of the marine ranching platform; in case of failing to make rectification upon dissuasion, be reported to the fishery department for further disposal. The fishery department shall carry out criticism and education on the illegal temporary personnel, order such personnel to make rectification, issue an warning and impose a fine of no less than RMB 200 and no more than RMB 500 thereon.

Chapter VI Supplementary Provisions

Article 31 The words and expressions as referred to in these Regulations shall have the following meaning:

(i) “marine ranching” refers to the fishery mode of constructing or restoring the necessary places for breeding, development, forage, or enemy avoidance of marine organisms in designated sea areas in accordance with the principle of marine ecological system by such means as construction of artificial fish reef, reproduction and releasing, and stereoscopic cultivation, with a view of proliferating and maintaining fishery resources, improving marine ecological environment, and realizing the sustainable utilization of fishery resources;

(ii) “marine ranching platform” refers to the facilities established within the sea areas of marine ranching for the implementation of environmental monitoring, fishery production, platform care, fishery experience, ecological tourism, safety relief and otherwise;

(iii) “artificial fish reef” refers to the artificial structures established in the natural sea areas for the purposes of restoring and optimizing marine ecological environment and protecting and proliferating fishery resources;

(iv) “temporary personnel” refers to the personnel temporarily getting on the marine ranching platform to engage in such activities as fishery experience and ecological tourism.

Article 32 These Regulations shall come into force as of May 1, 2022.
